A bill for an act
relating to labor and industry; allowing municipalities to adopt ordinances in
addition to the State Building Code; amending Minnesota Statutes 2008, sections
326B.106, by adding a subdivision; 326B.121, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 326B.106, is amended by adding a
subdivision to read:

new text begin Optional municipal ordinances. new text end

new text begin The commissioner of labor and
industry, consistent with the recommendations of the State Fire Marshal, shall adopt
rules regulating the authority of municipalities to adopt and enforce optional housing,
property maintenance, or rental licensing ordinances regulating components or systems of
existing buildings.

new text begin Consideration must be given in these optional rules to address what level of
regulatory provisions are allowed to be applied retroactively to existing buildings by
municipalities in addition to any maintenance provisions in the State Building Code or
State Fire Code. These optional ordinances may address issuance, denial, or revocation of
approvals or licenses and may include provisions that are not part of the State Building
Code or State Fire Code and would not be considered in conflict with the State Building
Code or State Fire Code.

Sec. 2.

Minnesota Statutes 2008, section 326B.121, is amended by adding a
subdivision to read:

new text begin A municipality may adopt and enforce a housing,
property maintenance, or rental licensing ordinance and not be in conflict with the State
Building Code or this section provided the adopted ordinance does not require provisions
that conflict with the rules adopted pursuant to the authority of section 326B.106,
subdivision 13.

new text begin Notwithstanding the provisions of this section and rules adopted pursuant to
section 326B.106, subdivision 13, in order to protect public health, safety, and welfare, a
municipality may by ordinance adopt a requirement that exterior work authorized by a
building permit issued in accordance with the State Building Code be completed within a
specified number of days following issuance of the building permit.
