  1.1                          A bill for an act 
  1.2             relating to education; modifying referendum allowance 
  1.3             reduction and equalization revenue; appropriating 
  1.4             money; amending Minnesota Statutes 1996, section 
  1.5             124A.03, subdivisions 1f and 3c. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 124A.03, 
  1.8   subdivision 1f, is amended to read: 
  1.9      Subd. 1f.  [REFERENDUM EQUALIZATION REVENUE.] A district's 
  1.10  referendum equalization revenue equals $315 $400 times the 
  1.11  district's actual pupil units for that year. 
  1.12     Referendum equalization revenue must not exceed a 
  1.13  district's total referendum revenue for that year. 
  1.14     Sec. 2.  Minnesota Statutes 1996, section 124A.03, 
  1.15  subdivision 3c, is amended to read: 
  1.16     Subd. 3c.  [REFERENDUM ALLOWANCE REDUCTION.] For fiscal 
  1.17  year 1998 and later, a district's referendum allowance for 
  1.18  referendum authority under subdivision 1c is reduced as provided 
  1.19  in this subdivision.  
  1.20     (a) For referendum revenue authority approved before June 
  1.21  1, 1996, and effective for fiscal year 1997, the reduction 
  1.22  equals the amount of the reduction computed for fiscal year 1997 
  1.23  under subdivision 3b times the lesser of one or the ratio of the 
  1.24  referendum allowance for the district to the amount determined 
  1.25  in subdivision 1c, clause (2), for fiscal year 1997.  
  2.1      (b) For referendum revenue authority approved before June 
  2.2   1, 1996, and effective beginning in fiscal year 1998, the 
  2.3   reduction equals the amount of the reduction computed for fiscal 
  2.4   year 1998 under subdivision 3b times the lesser of one or the 
  2.5   ratio of the referendum allowance for the district to the amount 
  2.6   determined in subdivision 1c, clause (2), for fiscal year 1998.  
  2.7      (c) For referendum revenue authority approved after May 31, 
  2.8   1996, there is no reduction.  
  2.9      (d) For districts with more than one referendum authority, 
  2.10  the reduction shall be computed separately for each authority.  
  2.11  The reduction shall be applied first to authorities levied 
  2.12  against tax capacity, and then to authorities levied against 
  2.13  referendum market value.  For districts with more than one 
  2.14  authority levied against net tax capacity or against referendum 
  2.15  market value, the referendum allowance reduction shall be 
  2.16  applied first to the authority with the earliest expiration date.
  2.17     (e) For a newly reorganized district created after July 1, 
  2.18  1996, the referendum revenue reduction equals the lesser of the 
  2.19  amount calculated for the combined district, or the sum of the 
  2.20  amounts by which each of the reorganizing district's 
  2.21  supplemental revenue reduction exceeds its respective 
  2.22  supplemental revenue allowances calculated for the year 
  2.23  preceding the year of reorganization. 
  2.24     Sec. 3.  [GRADUATION RULE IMPLEMENTATION AID.] 
  2.25     If a district qualifies for additional revenue under 
  2.26  section 1, it qualifies for additional graduation rule 
  2.27  implementation aid.  For fiscal year 1998 and fiscal year 1999, 
  2.28  only a qualifying district shall receive $....... times the 
  2.29  number of pupil units in the district for that year.  The 
  2.30  purpose of this aid is to help low per pupil revenue districts 
  2.31  with one-time implementation costs of the graduation rule. 
  2.32     Sec. 4.  [APPROPRIATION.] 
  2.33     $....... is appropriated in fiscal year 1998 and $....... 
  2.34  is appropriated in fiscal year 1999 to the commissioner of 
  2.35  children, families, and learning from the general fund for the 
  2.36  purpose of section 3. 
  3.1      Sec. 5.  [EFFECTIVE DATE.] 
  3.2      Sections 1 and 2 are effective for revenue for fiscal year 
  3.3   1998 and thereafter.
