A bill for an act
relating to human services; requiring prior authorization for cesarean deliveries;
amending Minnesota Statutes 2008, section 256B.0625, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 256B.0625, is amended by adding a
subdivision to read:

new text begin Prior authorization for cesarean delivery. new text end

new text begin (a) The commissioner shall
require prior authorization before a cesarean delivery is eligible for payment unless the
cesarean delivery is determined to be an emergency or necessary to save the life or health
of the woman or the unborn child.

new text begin (b) Prior authorization shall only be provided for cesarean deliveries that are
determined to be medically necessary.
