  1.1                          A bill for an act 
  1.2             relating to local government; authorizing a host 
  1.3             community fee; amending Minnesota Statutes 2002, 
  1.4             section 298.75, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 298.75, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 9.  [CITY OR TOWN FEE AUTHORITY.] (a) A city or town 
  1.9   located in a county that imposes a tax under this section may 
  1.10  impose a fee, not to exceed 30 cents per ton of aggregate 
  1.11  material produced in the city or town for which an aggregate 
  1.12  material production tax is due. 
  1.13     (b) The aggregate host fee imposed by a city or town must 
  1.14  be paid together with the county aggregate tax, but must be 
  1.15  reported separately as the city or town aggregate host fee by 
  1.16  the owner or operator or importer at the time of payment.  
  1.17  Cities or towns imposing the fee authorized by this subdivision 
  1.18  must provide the county auditor with written notice that the fee 
  1.19  must be paid with the aggregate tax.  
  1.20     (c) The county auditor shall pay to the city or town the 
  1.21  fees collected pursuant to this subdivision within 30 days of 
  1.22  receipt by the county.  Twenty-five percent of the aggregate 
  1.23  host fee revenue must be used only for the purposes of 
  1.24  mitigating and compensating for the adverse effects of aggregate 
  1.25  mining material.  The remainder of the aggregate host fee may be 
  2.1   credited to the general fund or other designated fund of the 
  2.2   city or town. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective for aggregate material removed after 
  2.5   June 30, 2003.
