  1.1                          A bill for an act
  1.2             relating to education; establishing a block grant 
  1.3             program for American Indian education; appropriating 
  1.4             money; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 124; repealing Minnesota Statutes 
  1.6             1994, sections 124.48; 124.481; 124.86, subdivision 4; 
  1.7             and 125.62. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [124.482] [AMERICAN INDIAN EDUCATION BLOCK 
  1.10  GRANTS.] 
  1.11     Subdivision 1.  [ESTABLISHMENT.] On or before July 15 of 
  1.12  each fiscal year, the commissioner of education shall certify to 
  1.13  the American Indian education aid distribution council the block 
  1.14  grant amount for that fiscal year.  The block grant amount is 
  1.15  equal to the state appropriation for the purposes of the 
  1.16  American Indian education act, any specific state appropriation 
  1.17  for the block grant, plus the matching funds required under 
  1.18  subdivision 2, less any reductions to compensate for 
  1.19  insufficient match funds in the previous fiscal year.  For 
  1.20  fiscal year 1996, there shall be no reduction for match 
  1.21  requirements.  The block grant shall be administered by the 
  1.22  American Indian education distribution council under subdivision 
  1.23  3.  The block grant must be used for the purposes of American 
  1.24  Indian education. 
  1.25     Subd. 2.  [MATCH.] Except for grants to school districts 
  1.26  under sections 126.45 to 126.55, no grants shall be made under 
  2.1   this section until matching funds have been pledged.  Each 
  2.2   fiscal year, the American Indian education aid distribution 
  2.3   council shall pledge matching funds for the American Indian 
  2.4   education block grant.  For fiscal year 1996 and thereafter, the 
  2.5   match must at least equal $900,000 from nonstate funds.  The 
  2.6   council must certify the amount and source of the matching funds 
  2.7   to the commissioner of education in the American Indian 
  2.8   education aid distribution plan. 
  2.9      Subd. 3.  [AMERICAN INDIAN EDUCATION AID DISTRIBUTION 
  2.10  COUNCIL.] The council shall consist of representatives of each 
  2.11  of the American Indian tribes in Minnesota.  The council must 
  2.12  reflect the state's population distribution of American Indian 
  2.13  residents from American Indian tribes in Minnesota.  Each tribe 
  2.14  must be represented on the council.  The representatives from 
  2.15  each tribe shall be appointed by the tribe.  The purpose of the 
  2.16  American Indian education aid distribution council is to 
  2.17  designate, by majority resolution, the distribution of the block 
  2.18  grant among the possible education uses through the education 
  2.19  aid distribution plan.  The council must also identify the 
  2.20  extent of each tribe's contribution to the match requirements. 
  2.21     Subd. 4.  [EDUCATION AID DISTRIBUTION PLAN.] (a) By August 
  2.22  1 of each fiscal year, the American Indian education aid 
  2.23  distribution council shall provide the commissioner of education 
  2.24  with an education aid distribution plan.  The plan must 
  2.25  distribute the block grant for educational purposes among 
  2.26  possible educational uses.  The plan must include grants to 
  2.27  school districts for the total amount of the state appropriation 
  2.28  for the American Indian education act according to sections 
  2.29  126.45 to 126.55.  The plan must also identify the amount of 
  2.30  matching funds, the sources of the matching funds, and the date 
  2.31  when the matching funds will be deposited in an account 
  2.32  controlled by the American Indian education aid distribution 
  2.33  council.  Beginning with the plan due on August 1, 1996, the 
  2.34  plan must also summarize grants given by the council in the 
  2.35  previous fiscal year. 
  2.36     (b) If, by August 15, the council has reached a consensus 
  3.1   on a plan for the distribution of American Indian education aid, 
  3.2   the commissioner shall distribute the full grant amount to the 
  3.3   account established for that purpose.  If the council does not 
  3.4   provide a plan, the total amount of the grant appropriation, 
  3.5   less the amount for grants under section 126.54, subdivision 1, 
  3.6   shall revert to the general fund.  The commissioner of education 
  3.7   shall then make grants according to sections 126.45 to 126.55. 
  3.8      Subd. 5.  [USES OF BLOCK GRANT.] The American Indian 
  3.9   education aid distribution council shall allocate the block 
  3.10  grant for the education of American Indians who are Minnesota 
  3.11  residents or for programs that will support the educational 
  3.12  attainment of resident American Indians.  The council may 
  3.13  distribute funds to: 
  3.14     (1) school districts or groups of school districts 
  3.15  enrolling American Indians; 
  3.16     (2) tribal contract schools as defined in section 124.86, 
  3.17  subdivision 1; 
  3.18     (3) Minnesota public post-secondary institutions for the 
  3.19  benefit of American Indian students; 
  3.20     (4) a Minnesota resident of American Indian ancestry for 
  3.21  post-secondary education and preparation for post-secondary 
  3.22  study; and 
  3.23     (5) other educational institutions or purposes, as deemed 
  3.24  appropriate. 
  3.25     By June 30 of the fiscal year for which the block grant is 
  3.26  made, all block grant funds must be committed to specific 
  3.27  purposes and recipients according to the plan under subdivision 
  3.28  4. 
  3.29     Sec. 2.  [APPROPRIATIONS.] 
  3.30     The sums indicated in this section are appropriated from 
  3.31  the general fund to the department of education for the fiscal 
  3.32  years designated. 
  3.33     Subdivision 1.  [AMERICAN INDIAN LANGUAGE AND CULTURE 
  3.34  PROGRAMS.] For grants to American Indian language and culture 
  3.35  education programs according to Minnesota Statutes, section 
  3.36  126.54, subdivision 1. 
  4.1        $515,000     .....     1996 
  4.2        $502,000     .....     1997 
  4.3      The 1996 appropriation includes $88,000 for 1995 and 
  4.4   $427,000 for 1996.  
  4.5      The 1997 appropriation includes $75,000 for 1996 and 
  4.6   $427,000 for 1997. 
  4.7      Any balance the first year does not cancel but is available 
  4.8   in the second. 
  4.9      Subd. 2.  [AMERICAN INDIAN EDUCATION BLOCK GRANT.] For 
  4.10  grants to support American Indian education under Minnesota 
  4.11  Statutes, section 124.482.
