A bill for an act
relating to public safety; requiring the Minnesota Sentencing Guidelines
Commission to report additional information on certain sentences where the
mandatory minimum was not imposed; amending Minnesota Statutes 2022, section
244.09, subdivision 14.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 244.09, subdivision 14, is amended to read:


Subd. 14.

Report on mandatory minimum sentences.

Commission shall include in its annual report to the legislature a summary and analysis of
reports received from county attorneys under section 609.11, subdivision 10.

new text begin (b) For offenses listed in section 609.11, subdivision 9, where the mandatory minimum
sentence was not imposed, the summary and analysis required under paragraph (a) must
include:

new text begin (1) the name of the offender;
new text end

new text begin (2) a description of the facts of the case;
new text end

new text begin (3) the applicable mandatory minimum sentence;
new text end

new text begin (4) the sentence imposed;
new text end

new text begin (5) whether the sentence was stayed or executed and, if stayed, the length of probation
ordered;

new text begin (6) the name of the judge;
new text end

new text begin (7) the name of the chief prosecutor; and
new text end

new text begin (8) the person who recommended the reduced sentence.

new text begin (c) The information required under paragraph (b) must be made publicly available on
the website of the Sentencing Guidelines Commission.
