  1.1                          A bill for an act 
  1.2             relating to highways; authorizing commissioner of 
  1.3             transportation to enter into lease agreements for 
  1.4             highway rest areas; depositing money in special 
  1.5             revenue fund; appropriating money for highway rest 
  1.6             stop program; requiring commissioner to report to 
  1.7             legislature; amending Minnesota Statutes 2002, section 
  1.8             160.28, by adding a subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 160.28, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 3.  [REST AREA LEASE AGREEMENTS.] (a) The 
  1.13  commissioner may enter into lease agreements with local units of 
  1.14  government or private or nonprofit entities, relating to the use 
  1.15  of highway rest areas. 
  1.16     (b) A lease agreement may: 
  1.17     (1) prescribe a term of up to five years, and may be 
  1.18  renewable for additional terms; 
  1.19     (2) provide that some or all of the consideration to be 
  1.20  furnished by the lessee may be in the form of an in-kind 
  1.21  contribution to the improvement, maintenance, or operation of 
  1.22  the rest area; 
  1.23     (3) allow the lessee to add leasehold improvements to the 
  1.24  site; and 
  1.25     (4) allow the lessee to operate all or part of the rest 
  1.26  area facility, and to offer for sale, products or services that 
  1.27  the commissioner deems appropriate to sell in a highway rest 
  2.1   stop. 
  2.2      (c) A lease agreement for a rest stop on a trunk highway or 
  2.3   interstate highway is subject to section 160.282 and must allow 
  2.4   for the commissioner to negotiate maintenance service agreements 
  2.5   that promote and encourage the employment of needy, elderly 
  2.6   persons. 
  2.7      (d) Revenues from leases authorized under this section must 
  2.8   be deposited in a highway rest stop lease account in the special 
  2.9   revenue fund.  Money in the account is appropriated to the 
  2.10  commissioner of transportation to administer the highway rest 
  2.11  stop program. 
  2.12     Sec. 2.  [REPORT.] 
  2.13     To the greatest extent possible, the commissioner shall 
  2.14  enter into lease agreements for the use of highway rest areas, 
  2.15  as described in section 1.  On or before January 15, 2005, the 
  2.16  commissioner shall report to the house of representatives and 
  2.17  senate committees with jurisdiction over transportation policy 
  2.18  and finance concerning existing lease agreements, revenues 
  2.19  collected, projected revenues, and the impact of the lease 
  2.20  agreements and revenues on the highway rest area program.
