1.1 A bill for an act 1.2 relating to labor; modifying prevailing wage rate 1.3 determination method; amending Minnesota Statutes 1.4 2002, section 177.42, subdivision 6. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2002, section 177.42, 1.7 subdivision 6, is amended to read: 1.8 Subd. 6. [PREVAILING WAGE RATE.] "Prevailing wage rate" 1.9 means the hourly basic rate of pay plus the contribution for 1.10 health and welfare benefits, vacation benefits, pension 1.11 benefits, and any other economic benefit paid to thelargest1.12numbermajority of workers engaged in the same class of labor 1.13 within the area and includes, for the purposes of section 1.14 177.44, rental rates for truck hire paid to those who own and 1.15 operate the truck. If the same wage rate is not paid to a 1.16 majority of those engaged in the same class of labor within the 1.17 area, the prevailing wage rate shall be the average wage rate 1.18 paid, weighted by the total engaged in the same class of labor. 1.19 The prevailing wage rate may not be less than a reasonable and 1.20 living wage.
