  1.1                          A bill for an act 
  1.2             relating to housing; providing that the Minnesota 
  1.3             housing finance agency may not establish different 
  1.4             income limits for applicants based on their geographic 
  1.5             location; appropriating money for the development of 
  1.6             computer software; amending Minnesota Statutes 1996, 
  1.7             section 462A.03, subdivision 10. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 462A.03, 
  1.10  subdivision 10, is amended to read: 
  1.11     Subd. 10.  [PERSONS AND FAMILIES OF LOW AND MODERATE 
  1.12  INCOME.] "Persons and families of low and moderate income" means 
  1.13  persons and families, irrespective of race, creed, national 
  1.14  origin, sex, or status with respect to guardianship or 
  1.15  conservatorship, determined by the agency to require such 
  1.16  assistance as is made available by sections 462A.01 to 462A.24 
  1.17  on account of personal or family income not sufficient to afford 
  1.18  adequate housing.  In making such determination the agency shall 
  1.19  take into account the following:  (a) The amount of the total 
  1.20  income of such persons and families available for housing needs, 
  1.21  (b) the size of the family, (c) the cost and condition of 
  1.22  housing facilities available, (d) the eligibility of such 
  1.23  persons and families to compete successfully in the normal 
  1.24  housing market and to pay the amounts at which private 
  1.25  enterprise is providing sanitary, decent and safe housing.  In 
  1.26  the case of federally subsidized mortgages with respect to which 
  2.1   income limits have been established by any agency of the federal 
  2.2   government having jurisdiction thereover for the purpose of 
  2.3   defining eligibility of low and moderate income families, the 
  2.4   limits so established shall govern under the provision of 
  2.5   sections 462A.01 to 462A.24.  In all other cases income limits 
  2.6   for the purpose of defining low or moderate income persons shall 
  2.7   be established by the agency by emergency or permanent 
  2.8   rules.  Notwithstanding any other law to the contrary, the 
  2.9   agency may not establish different income limits for applicants 
  2.10  based on their geographic location within the state. 
  2.11     Sec. 2.  [APPROPRIATION.] 
  2.12     $....... is appropriated from the general fund to the 
  2.13  commissioner of the Minnesota housing finance agency for the 
  2.14  purpose of developing computer software to help nonmetropolitan 
  2.15  area banks participate in housing assistance programs funded in 
  2.16  part or in whole by the housing finance agency.  The 
  2.17  appropriation is available for the biennium ending June 30, 1999.
