A bill for an act
relating to capital investment; appropriating money
for capital projects to enable the reuse of Fergus
Falls Regional Treatment Center; authorizing the sale
and issuance of state bonds; conveying certain surplus
state land; amending Minnesota Statutes 2004, section
245.036.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 245.036, is
amended to read:


245.036 LEASES FOR STATE-OPERATED, COMMUNITY-BASED
PROGRAMS.

new text begin (a) new text end Notwithstanding section 16B.24, subdivision 6,
paragraph (a), or any other law to the contrary, the
commissioner of administration may lease land or other premises
to provide state-operated, community-based programs authorized
by sections 252.50, 253.018, and 253.28 for a term of 20 years
or less, with a ten-year new text begin or less new text end option to renew, subject to
cancellation upon 30 days' notice by the state for any reason,
except rental of other land or premises for the same use.

Sec. 2. new text begin APPROPRIATION; DEPARTMENT OF ADMINISTRATION -
FERGUS FALLS REGIONAL TREATMENT CENTER.

new text begin (a) The projects funded in this section must be implemented
consistent with the recommendations in the final Fergus Falls
Regional Treatment Center Master Plan and Reuse Study prepared
and approved under Laws 2003, First Special Session chapter 14,
article 6, section 64, subdivision 2, unless expressly provided
otherwise.

new text begin (b) $400,000 is appropriated from the bond proceeds fund to
the commissioner of employment and economic development for a
grant to the city of Fergus Falls to demolish the waste
incinerator and steam heating facility at the Fergus Falls
Regional Treatment Center, dispose of any hazardous materials,
and fill the site.

new text begin (c) $2,385,000 is appropriated from the bond proceeds fund
to the commissioner of finance to retire municipal bonds issued
by the city of Fergus Falls and to retire interfund loans
incurred by the city of Fergus Falls in connection with the
waste incinerator and steam heating facility at the Fergus Falls
Regional Treatment Center.

Sec. 3. new text begin BOND SALE.

new text begin To provide the money appropriated by section 2, from the
bond proceeds fund, the commissioner of finance shall sell and
issue bonds of the state in an amount up to $2,785,000 in the
manner, on the terms, and with the effect prescribed by
Minnesota Statutes, sections 16A.631 to 16A.675, and by the
Minnesota Constitution, article XI, sections 4 to 7.

Sec. 4. new text begin CONVEYANCE OF SURPLUS STATE LAND; FERGUS FALLS.

new text begin (a) Notwithstanding Minnesota Statutes, sections 16B.281 to
16B.287, or other law, administrative rule, or commissioner's
order to the contrary, the commissioner of administration may
convey to one or more local units of government for no
consideration all or part of the real property at the Fergus
Falls Regional Treatment Center for public purposes consistent
with the master plan and reuse study. The conveyance shall be
in a form approved by the attorney general and subject to
Minnesota Statutes, section 16A.695.

new text begin (b) Notwithstanding Minnesota Statutes, section 16C.23, the
commissioner of administration may convey to one or more local
units of government for no consideration all or part of the
personal property determined by the commissioner of human
services to be no longer needed for its operations.

new text begin (c) If a local unit of government sells any property
conveyed under this section to a private entity, the sale must
be at a fair market value.

Sec. 5. new text begin WAIVER.
new text end

new text begin The provisions, terms, and conditions of any grant made by
the director of the Office of Environmental Assistance under
Minnesota Statutes, chapter 115A, to the city of Fergus Falls
for the waste incinerator and steam heating facility which
supports the Fergus Falls Regional Treatment Center, and which
may come into effect as a result of the incinerator and facility
being closed by the city of Fergus Falls, are hereby waived.
