A bill for an act
relating to human services; providing requirements for the administration of
nonemergency transportation services.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin REQUEST FOR PROPOSALS.

new text begin (a) The commissioner of human services shall issue a request for proposals to
provide nonemergency transportation services under Minnesota Statutes, section 256B.04,
subdivision 14, through a statewide full-risk brokerage model that uses a prepaid
capitation rate to reimburse the selected broker. The proposals shall incorporate an in-state
call center for all Medicaid nonemergency transportation services. The commissioner
shall issue the request for proposals by August 15, 2013.

new text begin (b) All bids submitted under paragraph (a) shall be actuarially sound to ensure that
all performance requirements can be met and quality service delivery is maintained.
Upon the completion of the formal bidding process, an independent third-party evaluation
committee, not affiliated with the Department of Human Services, shall be responsible for
evaluating all proposals and making final determinations regarding all contract awards.

new text begin (c) Upon determination of a winning bid, the commissioner shall immediately
apply to the Centers for Medicare and Medicaid Services for a state plan amendment as
provided for in the Social Security Act, section 1902(a)(70), and according to Code of
Federal Regulations, title 42, section 440.170(a)(4). The state plan amendment shall
allow the commissioner to operate the nonemergency medical transportation system in a
manner that enhances access to health care services, improves the quality of transportation
delivered, and provides for a more cost-effective approach based on cost containment
and budget predictability.
