  1.1                          A bill for an act 
  1.2             relating to corrections; creating the site selection 
  1.3             committee to recommend sites for future correctional 
  1.4             facilities; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 243. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [243.92] [CORRECTIONAL FACILITY SITE SELECTION 
  1.8   COMMITTEE.] 
  1.9      Subdivision 1.  [CREATION; MEMBERSHIP.] (a) An advisory 
  1.10  task force is created to coordinate the site selection process 
  1.11  for state correctional facilities.  The task force shall convene 
  1.12  when the legislature authorizes specific facility planning.  The 
  1.13  task force, to be known as the site selection committee, 
  1.14  consists of voting members described in paragraph (b) and 
  1.15  nonvoting members described in paragraph (c). 
  1.16     (b) Voting members include the: 
  1.17     (1) commissioner of corrections or the commissioner's 
  1.18  designee; 
  1.19     (2) deputy commissioner of corrections who has supervision 
  1.20  and control over correctional facilities; 
  1.21     (3) commissioner of transportation or the commissioner's 
  1.22  designee; 
  1.23     (4) commissioner of administration or the commissioner's 
  1.24  designee; 
  1.25     (5) chair of the senate crime prevention finance division 
  2.1   and the ranking member of that division from the minority 
  2.2   political caucus; and 
  2.3      (6) chair of the house judiciary finance committee and the 
  2.4   ranking member of that committee from the minority political 
  2.5   caucus. 
  2.6      (c) Nonvoting members include the following: 
  2.7      (1) senators and representatives selected by the senate 
  2.8   subcommittee on committees and speaker of the house to represent 
  2.9   the geographical locations under consideration when construction 
  2.10  of a correctional facility is contemplated; and 
  2.11     (2) additional departments of corrections and 
  2.12  administration employees, and others selected and appointed by 
  2.13  the chairs of the committee. 
  2.14     (d) The chairs of the senate crime prevention finance 
  2.15  division and house judiciary finance committee shall chair the 
  2.16  committee. 
  2.17     Subd. 2.  [SITE SELECTION PROCESS.] The committee shall 
  2.18  develop a correctional site selection process that most 
  2.19  effectively and efficiently utilizes state financial resources 
  2.20  for construction of correctional facilities.  The committee may 
  2.21  include such other factors as the committee considers relevant 
  2.22  as criteria for the site selection process. 
  2.23     Subd. 3.  [RECOMMENDATIONS.] Before recommendation of an 
  2.24  individual site for a correctional facility, the committee shall 
  2.25  require that all costs associated with the facility and the site 
  2.26  be identified and reported, including but not limited to 
  2.27  construction costs, site improvement, infrastructure upgrades, 
  2.28  and operating costs for that site.  The commissioners of 
  2.29  administration and corrections and any other agencies involved 
  2.30  with site construction or land acquisition shall cooperate with 
  2.31  the committee in supplying information described in this 
  2.32  subdivision and any other information required for project 
  2.33  budgets under section 16B.335. 
  2.34     Subd. 4.  [REPORT.] The committee shall report its 
  2.35  recommendations for the siting of correctional facilities to the 
  2.36  legislature. 
  3.1      Subd. 5.  [LEGISLATIVE AUTHORIZATION OF SITE.] Each site 
  3.2   for a new state of Minnesota correctional facility shall be 
  3.3   chosen in the law authorizing and providing funding for the 
  3.4   facility. 
  3.5      Sec. 2.  [STAFFING.] 
  3.6      The site selection committee may utilize employees from the 
  3.7   legislative and executive branch entities with membership on the 
  3.8   committee.  The department of administration shall provide 
  3.9   administrative support with the agency's appropriation from the 
  3.10  current fiscal biennium.
