  1.1                          A bill for an act
  1.2             relating to health; exempting breast-feeding from 
  1.3             indecent exposure; amending Minnesota Statutes 1994, 
  1.4             section 617.23; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 145. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [145.87] [BREAST FEEDING.] 
  1.8      A mother may breast-feed her baby in any location, public 
  1.9   or private, where the mother is otherwise authorized to be, 
  1.10  irrespective of whether the nipple of the mother's breast is 
  1.11  uncovered during or incidental to the breast-feeding. 
  1.12     Sec. 2.  Minnesota Statutes 1994, section 617.23, is 
  1.13  amended to read: 
  1.14     617.23 [INDECENT EXPOSURE; PENALTIES.] 
  1.15     (a) Every person who shall willfully and lewdly expose the 
  1.16  person's body, or the private parts thereof, in any public 
  1.17  place, or in any place where others are present, or shall 
  1.18  procure another to expose private parts, and every person who 
  1.19  shall be guilty of any open or gross lewdness or lascivious 
  1.20  behavior, or any public indecency other than hereinbefore 
  1.21  specified, shall be guilty of a misdemeanor. 
  1.22     (b) A person is guilty of a gross misdemeanor if the person 
  1.23  violates this section after having been previously convicted of 
  1.24  violating this section, sections 609.342 to 609.3451, or a 
  1.25  statute from another state in conformity with any of those 
  2.1   sections. 
  2.2      (c) Notwithstanding any other provision of law, a woman may 
  2.3   breast-feed in any public or private location where she is 
  2.4   otherwise authorized to be, irrespective of whether the nipple 
  2.5   of the mother's breast is uncovered during or incidental to the 
  2.6   breast-feeding.
