  1.1                          A bill for an act 
  1.2             relating to gambling; permitting veterans' 
  1.3             organizations and licensed establishments that sell 
  1.4             alcoholic beverages to conduct contests involving 
  1.5             certain card games; amending Minnesota Statutes 1996, 
  1.6             sections 340A.410, subdivision 5; and 609.761, by 
  1.7             adding a subdivision.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 340A.410, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [GAMBLING PROHIBITED.] (a) No retail 
  1.12  establishment licensed to sell alcoholic beverages may keep, 
  1.13  possess, or operate, or permit the keeping, possession, or 
  1.14  operation on the licensed premises of dice or any gambling 
  1.15  device as defined in section 349.30, or permit gambling therein 
  1.16  except as provided in this subdivision.  
  1.17     (b) Gambling equipment may be kept or operated and raffles 
  1.18  conducted on licensed premises and adjoining rooms when the use 
  1.19  of the gambling equipment is authorized by (1) chapter 349, (2) 
  1.20  a tribal ordinance in conformity with the Indian Gaming 
  1.21  Regulatory Act, Public Law Number 100-497, or (3) a tribal-state 
  1.22  compact authorized under section 3.9221. 
  1.23     (c) Lottery tickets may be purchased and sold within the 
  1.24  licensed premises as authorized by the director of the lottery 
  1.25  under chapter 349A.  
  1.26     (d) Tournaments or contests consisting of card games of 
  2.1   chance may be conducted on the licensed premises as authorized 
  2.2   under section 609.761, subdivision 3. 
  2.3      Sec. 2.  Minnesota Statutes 1996, section 609.761, is 
  2.4   amended by adding a subdivision to read: 
  2.5      Subd. 3.  [TOURNAMENTS.] Sections 609.755 and 609.76 do not 
  2.6   prohibit tournaments or contests promoted by a veterans' 
  2.7   organization or retail establishment licensed under chapter 340A 
  2.8   to sell alcoholic beverages and conducted on the organization's 
  2.9   or establishment's premises, provided that: 
  2.10     (1) the tournament or contest consists of the card games of 
  2.11  chance commonly known as smear, cribbage, euchre, pinochle, gin, 
  2.12  500, bridge, or whist, as those terms are defined by the 
  2.13  gambling control board by rule; 
  2.14     (2) the tournament or contest does not provide any 
  2.15  financial benefit to the organization or establishment; 
  2.16     (3) the sum of all prizes awarded for each tournament or 
  2.17  contest does not exceed $100; and 
  2.18     (4) the tournaments or contests are conducted by the 
  2.19  organization or establishment on 12 or fewer days in a calendar 
  2.20  year.
