A bill for an act
relating to the environment; adding perfluorochemicals under the definition of
hazardous substance for the purpose of the Minnesota Environmental Response
and Liability Act; amending Minnesota Statutes 2006, section 115B.02,
subdivision 8.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 115B.02, subdivision 8, is amended to read:


Subd. 8.

Hazardous substance.

"Hazardous substance" means:

(1) any commercial chemical designated pursuant to the Federal Water Pollution
Control Act, under United States Code, title 33, section 1321(b)(2)(A);

(2) any hazardous air pollutant listed pursuant to the Clean Air Act, under United
States Code, title 42, section 7412; deleted text begin and

(3) any hazardous wastenew text begin ; and

Hazardous substance does not include natural gas, natural gas liquids, liquefied
natural gas, synthetic gas usable for fuel, or mixtures of such synthetic gas and natural
gas, nor does it include petroleum, including crude oil or any fraction thereof which is
not otherwise a hazardous waste.
