  1.1                          A bill for an act 
  1.2             relating to education; allowing a school district to 
  1.3             withhold a transferring student's records until school 
  1.4             property is returned; amending Minnesota Statutes 
  1.5             1994, section 120.101, subdivision 5c. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 120.101, 
  1.8   subdivision 5c, is amended to read: 
  1.9      Subd. 5c.  [EDUCATION RECORDS.] (a) A school district from 
  1.10  which a student is transferring must transmit the student's 
  1.11  educational records, within ten business days of the date the 
  1.12  student withdraws, to the school district in which the student 
  1.13  is enrolling.  School districts must make reasonable efforts to 
  1.14  determine the school district in which a transferring student is 
  1.15  next enrolling in order to comply with this subdivision.  
  1.16     (b) Notwithstanding the ten-day requirement in paragraph 
  1.17  (a), a school district may withhold a transferring student's 
  1.18  records until the student has returned all school district 
  1.19  property to the district.  Within 12 business days of the date 
  1.20  the student withdraws, the school district shall notify the 
  1.21  student in writing of the district's refusal to transmit the 
  1.22  records and shall provide a list of the missing property.  The 
  1.23  district shall transmit the records within one business day of 
  1.24  receiving the property.
