  1.1                          A bill for an act 
  1.2             relating to natural resources; providing for aquatic 
  1.3             plant management funding; increasing watercraft 
  1.4             surcharge; modifying apportionment of gasoline fuel 
  1.5             tax for motorboats; appropriating money; amending 
  1.6             Minnesota Statutes 2002, sections 86B.415, subdivision 
  1.7             7; 296A.18, subdivision 2. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 86B.415, 
  1.10  subdivision 7, is amended to read: 
  1.11     Subd. 7.  [WATERCRAFT SURCHARGE.] A $5 $6 surcharge is 
  1.12  placed on each watercraft licensed under subdivisions 1 to 5 for 
  1.13  control, public awareness, law enforcement, monitoring, and 
  1.14  research of nuisance aquatic exotic species such as zebra 
  1.15  mussel, purple loosestrife, and Eurasian water milfoil in public 
  1.16  waters and public wetlands.  
  1.17     Sec. 2.  Minnesota Statutes 2002, section 296A.18, 
  1.18  subdivision 2, is amended to read: 
  1.19     Subd. 2.  [MOTORBOAT.] Approximately 1-1/2 1.54 percent of 
  1.20  all gasoline received in this state and 1-1/2 1.54 percent of 
  1.21  all gasoline produced or brought into this state, except 
  1.22  gasoline used for aviation purposes, is being used as fuel for 
  1.23  the operation of motorboats on the waters of this state and of 
  1.24  the total revenue derived from the imposition of the gasoline 
  1.25  fuel tax for uses other than for aviation purposes, 1-1/2 1.54 
  1.26  percent of such revenues is the amount of tax on fuel used in 
  2.1   motorboats operated on the waters of this state.  The amount of 
  2.2   unrefunded tax paid on gasoline used for motor boat purposes as 
  2.3   computed in this chapter shall be paid into the state treasury 
  2.4   and credited to a water recreation account in the special 
  2.5   revenue fund for acquisition, development, maintenance, and 
  2.6   rehabilitation of sites for public access and boating facilities 
  2.7   on public waters; lake and river improvement; state park 
  2.8   development; and boat and water safety. 
  2.9      Sec. 3.  [APPROPRIATION.] 
  2.10     $250,000 is appropriated from the water recreation account 
  2.11  in the special revenue fund to the commissioner of natural 
  2.12  resources for aquatic plant management control.  The 
  2.13  appropriation is available for the biennium ending June 30, 2005.
