  1.1                          A bill for an act 
  1.2             relating to crime prevention; prohibiting the POST 
  1.3             board from issuing new part-time peace officer 
  1.4             licenses after February 1, 1999; requiring current 
  1.5             licensed part-time peace officers to complete a 
  1.6             training course to have their licenses renewed; 
  1.7             capping the number of part-time peace officers a law 
  1.8             enforcement agency may employ; appropriating money; 
  1.9             amending Minnesota Statutes 1998, section 626.8465, 
  1.10            subdivision 2; proposing coding for new law in 
  1.11            Minnesota Statutes, chapter 626; repealing Minnesota 
  1.12            Statutes 1998, section 626.8463, subdivision 2. 
  1.13  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.14     Section 1.  Minnesota Statutes 1998, section 626.8465, 
  1.15  subdivision 2, is amended to read: 
  1.16     Subd. 2.  [PART-TIME PEACE OFFICER LICENSE, RESTRICTION.] 
  1.17  Subject to section 626.8468, subdivision 2, any individual 
  1.18  licensed by the board as a part-time peace officer shall be 
  1.19  eligible for appointment or employment anywhere in the state as 
  1.20  a part-time peace officer but not as a peace officer unless the 
  1.21  individual meets board training and licensing requirements then 
  1.22  in effect for peace officers. 
  1.23     Sec. 2.  [626.8468] [NO NEW PART-TIME PEACE OFFICER 
  1.24  LICENSES ISSUED; CURRENT PART-TIME PEACE OFFICERS TO TAKE 
  1.25  TRAINING COURSE FOR LICENSE RENEWAL.] 
  1.26     Subdivision 1.  [NO FUTURE ISSUANCE OF PART-TIME PEACE 
  1.27  OFFICER LICENSES; CURRENT PART-TIME PEACE OFFICERS MAY 
  1.28  CONTINUE.] The board may not issue a part-time peace officer's 
  1.29  license to a person who was not licensed as a part-time peace 
  2.1   officer on February 1, 1999.  A person who was licensed as a 
  2.2   part-time peace officer on February 1, 1999, may continue to be 
  2.3   licensed and must renew the license as provided in this section. 
  2.4      Subd. 2.  [CAP ON NUMBER OF PART-TIME PEACE OFFICERS PER 
  2.5   AGENCY.] A law enforcement agency that employed a licensed 
  2.6   part-time peace officer or officers on February 1, 1999, may 
  2.7   continue to do so.  However, no agency may employ more part-time 
  2.8   peace officers after February 1, 1999, than it did before that 
  2.9   date. 
  2.10     Subd. 3.  [TRAINING COURSE FOR PART-TIME PEACE 
  2.11  OFFICERS.] The board shall prepare a training course of a 
  2.12  minimum of 320 hours in duration for persons licensed as 
  2.13  part-time peace officers on February 1, 1999.  The course must 
  2.14  include instruction in at least the following matters:  patrol 
  2.15  tactics, crime investigation techniques, crash scene management, 
  2.16  traffic law enforcement, and report writing.  The course must be 
  2.17  offered free of charge in locations throughout the state. 
  2.18     Subd. 4.  [SUCCESSFUL COMPLETION OF TRAINING COURSE 
  2.19  REQUIRED.] All persons licensed as part-time peace officers must 
  2.20  successfully complete the training course described in 
  2.21  subdivision 3.  After January 1, 2001, the board may not renew 
  2.22  the license of a part-time peace officer who has not 
  2.23  successfully completed the course. 
  2.24     Subd. 5.  [CONTINUING EDUCATION.] In addition to 
  2.25  successfully completing the training course described in 
  2.26  subdivision 3, licensed part-time peace officers shall comply 
  2.27  with continuing education standards required by the board. 
  2.28     Sec. 3.  [APPROPRIATION.] 
  2.29     $....... is appropriated for the fiscal year ending June 
  2.30  30, 2000, from the general fund to the board of peace officer 
  2.31  standards and training to prepare and offer the training course 
  2.32  described in Minnesota Statutes, section 626.8468. 
  2.33     Sec. 4.  [REPEALER.] 
  2.34     Minnesota Statutes 1998, section 626.8463, subdivision 2, 
  2.35  is repealed. 
  2.36     Sec. 5.  [EFFECTIVE DATE.] 
  3.1      Sections 1, 2, and 4 are effective the day following final 
  3.2   enactment.
