  1.1                          A bill for an act 
  1.2             relating to highways; dedicating motor vehicle sales 
  1.3             tax receipts to transportation; proposing an amendment 
  1.4             to the Minnesota Constitution, article XIV; 
  1.5             appropriating money for eliminating trunk highway 
  1.6             bottlenecks in the metropolitan area and for 
  1.7             improvements on at-risk interregional corridors 
  1.8             outside the metropolitan area; requiring annual 
  1.9             reports to the major transportation projects 
  1.10            commission; amending Minnesota Statutes 2000, section 
  1.11            297B.09, subdivision 1.  
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Minnesota Statutes 2000, section 297B.09, 
  1.14  subdivision 1, is amended to read: 
  1.15     Subdivision 1.  [GENERAL FUND SHARE.] Money collected and 
  1.16  received under this chapter must be deposited as provided in 
  1.17  this subdivision.  
  1.18     Thirty-two percent of the money collected and received must 
  1.19  be deposited in the highway user tax distribution fund, and the 
  1.20  remaining 68 percent of the money must be deposited in the 
  1.21  general fund a surface transportation fund to be appropriated by 
  1.22  law.  
  1.23     Sec. 2.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.24     An amendment to the Minnesota Constitution, article XIV, is 
  1.25  proposed to the people.  If the amendment is adopted, a section 
  1.26  is added to article XIV, to read: 
  1.27     Sec. 12.  The proceeds from any tax on the sale of new and 
  1.28  used motor vehicles must be deposited in a surface 
  2.1   transportation fund to be appropriated by law. 
  2.2      Sec. 3.  [SUBMISSION TO VOTERS.] 
  2.3      The proposed amendment must be submitted to the people at 
  2.4   the 2002 general election.  The question submitted must be: 
  2.5      "Shall the Minnesota Constitution be amended to require the 
  2.6   proceeds from the sales tax on motor vehicles be deposited in a 
  2.7   surface transportation fund? 
  2.8                                      Yes .......
  2.9                                      No ........"
  2.10     Sec. 4.  [TRUNK HIGHWAYS; APPROPRIATION.] 
  2.11     (a) The following amounts are appropriated from the general 
  2.12  fund to the commissioner of transportation for the purposes 
  2.13  stated: 
  2.14     (1) $....... for state trunk highway improvements within 
  2.15  the seven-county metropolitan area primarily for the purpose of 
  2.16  improving traffic flow and expanding highway capacity by 
  2.17  eliminating traffic bottlenecks; and 
  2.18     (2) $....... for improvements on state trunk highways 
  2.19  outside the seven-county metropolitan area that the commissioner 
  2.20  designates as at-risk interregional corridors. 
  2.21     (b) This appropriation is available until June 30, 2005.  
  2.22  On July 1, 2005, any part of this appropriation not spent, 
  2.23  encumbered, or otherwise obligated by the commissioner cancels 
  2.24  to the trunk highway fund. 
  2.25     (c) On August 1 of each year through 2005, the commissioner 
  2.26  shall report to the major transportation projects commission 
  2.27  established under Minnesota Statutes, section 174.55, on the 
  2.28  status of each trunk highway project funded in whole or in part 
  2.29  from this appropriation.  The report must include: 
  2.30     (1) the full cost of the project, including inflation 
  2.31  assumptions used in determining the full cost; 
  2.32     (2) the status of construction and right-of-way 
  2.33  acquisition; 
  2.34     (3) a schedule for completing the project and 
  2.35  identification of possible obstacles to completing the project 
  2.36  according to the schedule; 
  3.1      (4) the status of environmental review of the project; and 
  3.2      (5) the status of the project in the commissioner's 
  3.3   statewide transportation improvement program. 
  3.4      Sec. 5.  [EFFECTIVE DATE.] 
  3.5      Section 1 is effective for money collected and received 
  3.6   after June 30, 2002.  Section 4 is effective July 1, 2001.
