  1.1                          A bill for an act
  1.2             relating to state government; changing the appointing 
  1.3             authority for certain members of the Minnesota state 
  1.4             high school league governing board; providing that the 
  1.5             league is subject to certain procedures; amending 
  1.6             Minnesota Statutes 1996, sections 128C.01, subdivision 
  1.7             4; and 128C.02, by adding subdivisions. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 128C.01, 
  1.10  subdivision 4, is amended to read: 
  1.11     Subd. 4.  [BOARD.] (a) The league must have a 20-member 
  1.12  governing board. 
  1.13     (1) The governor must appoint four members according to 
  1.14  section 15.0597.  Each of the four appointees must be a parent.  
  1.15  At least one of them must be an American Indian, an Asian, a 
  1.16  Black, or a Hispanic. 
  1.17     (2) The Minnesota association of secondary school 
  1.18  principals must appoint two of its members. 
  1.19     (3) The remaining 14 members must be selected according to 
  1.20  league bylaws. appointed by the governor according to section 
  1.21  15.0597, as follows: 
  1.22     (1) four parents; 
  1.23     (2) four representatives of class A schools; 
  1.24     (3) four representatives of class AA schools; 
  1.25     (4) two representatives of secondary school principals, one 
  1.26  from a class A school and one from a class AA school; 
  2.1      (5) one representative of boys sports; 
  2.2      (6) one representative of girls sports; 
  2.3      (7) one representative of music educators; 
  2.4      (8) one representative of speech educators; and 
  2.5      (9) two representatives of the Minnesota school boards 
  2.6   association. 
  2.7   At least one of the members must be an American Indian, an 
  2.8   Asian, a Black, or a Hispanic. 
  2.9      (b) The terms, compensation, removal of members, and the 
  2.10  filling of membership vacancies are governed by section 15.0575. 
  2.11     Sec. 2.  Minnesota Statutes 1996, section 128C.02, is 
  2.12  amended by adding a subdivision to read: 
  2.13     Subd. 8.  [EMPLOYEES.] The governor shall appoint an 
  2.14  executive director for the league, who serves at the pleasure of 
  2.15  the governor.  The executive director and assistant executive 
  2.16  directors serve in the unclassified state civil service.  
  2.17  Assistant executive directors serve at the pleasure of the 
  2.18  executive director.  Other employees of the league serve in the 
  2.19  classified state civil service. 
  2.20     Sec. 3.  Minnesota Statutes 1996, section 128C.02, is 
  2.21  amended by adding a subdivision to read: 
  2.22     Subd. 9.  [BUDGET.] The league is subject to the 
  2.23  commissioner of finance's rules and instructions governing 
  2.24  budget preparation.  The league budget must be submitted to the 
  2.25  commissioner of finance and to the legislature in the same 
  2.26  manner as budgets of executive branch agencies. 
  2.27     Sec. 4.  [TRANSITION.] 
  2.28     Subdivision 1.  [EMPLOYEES.] Persons employed by the league 
  2.29  on the effective date of section 2 in positions that are placed 
  2.30  in the classified state civil service become classified 
  2.31  employees of the league without competitive examination or a 
  2.32  probationary period.  Persons employed by the league on the 
  2.33  effective date of section 2 in positions that are placed in the 
  2.34  unclassified state civil service remain in those positions at 
  2.35  the pleasure of the appointing authority. 
  2.36     Subd. 2.  [BOARD MEMBERS.] The governor shall make 
  3.1   appointments required by section 1 only upon the next expiration 
  3.2   of the terms of members currently serving on the board. 
  3.3      Sec. 5.  [EFFECTIVE DATE.] 
  3.4      Sections 1 to 4 are effective 30 days after final enactment.
