A bill for an act
relating to health; requiring commissioner of health to develop a uniform
formulary exception document; amending Minnesota Statutes 2008, section
62J.497, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 62J.497, is amended by adding a
subdivision to read:

commissioner of health, in consultation with the Minnesota Administrative Uniformity
Committee, shall develop a uniform prior authorization and formulary exception form that:

new text begin (1) allows health care providers to request exceptions from group purchaser drug
formularies using a standard form; and
new text end

new text begin (2) shall be submitted electronically by health care providers, and accepted and
processed by group purchasers, electronically through a secure Internet site.

new text begin Beginning January 1, 2011, all health care providers must submit requests for prior
authorization and formulary exceptions to group purchasers using the uniform prior
authorization and formulary exception form, and all group purchasers must accept this
form from health care providers electronically through a secure Internet site.
