  1.1                          A bill for an act 
  1.2             relating to data practices; classifying certificates 
  1.3             of discharge from military service filed with the 
  1.4             county recorder as private data; amending Minnesota 
  1.5             Statutes 2000, sections 13.785, by adding a 
  1.6             subdivision; and 386.20, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 13.785, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 3.  [CERTIFICATE OF DISCHARGE.] Access to 
  1.11  certificates of discharge from military service maintained by 
  1.12  county recorders is governed by section 386.20. 
  1.13     Sec. 2.  Minnesota Statutes 2000, section 386.20, is 
  1.14  amended by adding a subdivision to read: 
  1.15     Subd. 4.  [DATA CLASSIFICATION.] Certificates of discharge 
  1.16  recorded with the county recorder under this section are private 
  1.17  data on individuals as defined in section 13.02, but are 
  1.18  accessible to a parent, spouse, child, grandparent or 
  1.19  grandchild, personal representative of the estate, or next of 
  1.20  kin of the subject of the data.
