  1.1                          A bill for an act 
  1.2             relating to elections; permitting campaign signs in 
  1.3             highway rights-of-way under certain conditions; 
  1.4             amending Minnesota Statutes 2002, section 211B.045. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 211B.045, is 
  1.7   amended to read: 
  1.8      211B.045 [NONCOMMERCIAL SIGNS EXEMPTION SIGN EXEMPTIONS.] 
  1.9      Subdivision 1.  [NONCOMMERCIAL SIGNS.] In any municipality 
  1.10  with an ordinance that regulates the size of noncommercial 
  1.11  signs, notwithstanding the provisions of that ordinance, all 
  1.12  noncommercial signs of any size may be posted from August 1 in a 
  1.13  state general election year until ten days following the state 
  1.14  general election. 
  1.15     Subd. 2.  [CAMPAIGN SIGNS.] With the permission of the 
  1.16  owner of land that abuts and provides direct human access to a 
  1.17  state or county highway, other than an interstate or controlled 
  1.18  access highway, a person may post a sign containing only 
  1.19  campaign material within the portion of the highway right-of-way 
  1.20  that the land abuts from August 1 in a state general election 
  1.21  year until ten days following the state general election.  The 
  1.22  sign must not hide from view or interfere in any material degree 
  1.23  with the effectiveness of any traffic control device, sign, or 
  1.24  signal, or railroad sign or signal, or obstruct or interfere 
  1.25  with the driver's view of approaching, merging, or intersecting 
  2.1   traffic, and must comply with the other requirements of section 
  2.2   173.15.
