  1.1                          A bill for an act 
  1.2             relating to metropolitan airports; requiring 
  1.3             conveyance and reconveyance of land between 
  1.4             metropolitan airports commission and city of Richfield.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [CONVEYANCE OF LAND.] 
  1.7      (a) The metropolitan airports commission, on or about May 
  1.8   1, 1998, shall convey its right, title, and interest in and to 
  1.9   the land described in paragraph (c) to the city of Richfield for 
  1.10  no consideration other than as described in this section.  
  1.11  Consideration must include an annual payment by the city of 
  1.12  Richfield to the metropolitan airports commission on or before 
  1.13  the first day of April, in an amount equal to the average 
  1.14  payment made by the city of Richfield to the metropolitan 
  1.15  airports commission in respect of the land in the three 
  1.16  immediately preceding years. 
  1.17     (b) The land shall revert to the metropolitan airports 
  1.18  commission upon the earliest occurrence of the following: 
  1.19     (1) the use by the city of Richfield of the land for a 
  1.20  purpose other than public recreation; 
  1.21     (2) the completion of all environmental review processes 
  1.22  connected with any metropolitan airports commission improvement 
  1.23  on the described land, including any environmental assessment 
  1.24  worksheet, environmental impact statement, or record of 
  1.25  decision; or 
  2.1      (3) 90 days before the scheduled beginning of construction 
  2.2   on the described property by the metropolitan airports 
  2.3   commission of a capital project as defined in Minnesota 
  2.4   Statutes, section 473.621, subdivision 7, paragraphs (a) to (e). 
  2.5      (c) The land to be conveyed is located in Hennepin county 
  2.6   and is described as follows: 
  2.7      All that part of the North one half of the southwest 1/4 of 
  2.8   Sec. 25, township 28, range 24, lying east of highway 
  2.9   right-of-way, and south of the north 100.00 feet.  Also the west 
  2.10  900.00 feet of the north 900.00 feet of the southeast 1/4 of 
  2.11  said Sec. 25, except north 100.00 feet.  Also the south 1/2 of 
  2.12  the southwest 1/4 of the southwest 1/4 of said Sec. 25 lying 
  2.13  east of the highway right-of-way.  Also the southeast 1/4 of the 
  2.14  southwest 1/4 of said Sec. 25, except the east 248.00 feet of 
  2.15  the south 275.00 feet.  Also the west 1/2 of Sec. 36, township 
  2.16  28, Range 24, lying east of the highway right-of-way also lying 
  2.17  north and west of the following described meander line, said 
  2.18  meander line being referenced from the following described line; 
  2.19  said reference line beginning on the north line of said west 1/2 
  2.20  a distance of 80.0 feet west from the northeast corner of said 
  2.21  west 1/2, point of beginning shall be known as point "A", then 
  2.22  south westerly to a point on the west line of said Sec. 36, 
  2.23  2,660 feet north of southwest corner of said Sec. 36, there 
  2.24  terminating.  Said reference line being 1,000 feet northwest and 
  2.25  parallel to the center line runway 4-22.  On said reference line 
  2.26  a point known as point "B" being 200 feet southwesterly from 
  2.27  point "A", also a point known as point "C" being 700 feet 
  2.28  southwesterly from point "A", also a point known as point "D" 
  2.29  being 1,200 feet southwesterly from point "A", also a point 
  2.30  known as point "E" being 1,700 feet southwesterly from point 
  2.31  "A", also a point known as point "F" being 2,200 feet 
  2.32  southwesterly from point "A", also a point known as point "G" 
  2.33  being 2,700 feet southwesterly from point "A", also a point 
  2.34  known as point "H" being 3,200 feet southwesterly from point 
  2.35  "A".  All references to the known points will be at 90 degrees 
  2.36  to said reference line and to the right shall mean northwesterly 
  3.1   from said reference line and to the left means southeasterly 
  3.2   from said reference line.  The point of beginning for meander 
  3.3   line is on the north line, of west 1/2 of said Sec. 36, a 
  3.4   distance of 248 feet west from the northeast corner of said west 
  3.5   1/2, then southwesterly to 87' to the right of point "B", then 
  3.6   southwesterly to 50' to the right of point "C", then 
  3.7   southwesterly to point "D", then southwesterly to 50 feet to the 
  3.8   left of point "E" then southwesterly to 125 feet to the left of 
  3.9   point "F", then southwesterly to 225 feet to the left of point 
  3.10  "G", then southwesterly to 200 feet to the left of Point "H", 
  3.11  then southwesterly to a point on the west line, of said Sec. 36, 
  3.12  a distance of 2,500 feet north of the southwest corner of said 
  3.13  Sec. 36, there terminating. 
  3.14     (d) Notwithstanding paragraph (b), at such time as the 
  3.15  metropolitan airports commission identifies, develops, and makes 
  3.16  available to the city of Richfield, an alternative site on 
  3.17  airport property that provides the same number of baseball and 
  3.18  softball fields as are currently located on the property 
  3.19  described in paragraph (c), that portion of the described land 
  3.20  on which baseball and softball fields are located shall revert 
  3.21  to the metropolitan airports commission. 
  3.22     (e) The city of Richfield, during the period of its 
  3.23  ownership of the described land, shall not deny the metropolitan 
  3.24  airports commission reasonable access to the land in order to 
  3.25  perform minor construction associated with airport improvement 
  3.26  on that portion of the described land containing a golf course, 
  3.27  provided that the commission and its agents and contractors take 
  3.28  all reasonable and necessary steps during construction to 
  3.29  minimize interference with the daily operation of the golf 
  3.30  course. 
  3.31     Sec. 2.  [LOCAL APPROVAL AND EFFECTIVE DATE.] 
  3.32     Section 1 is effective the day after the governing body of 
  3.33  the city of Richfield complies with Minnesota Statutes, section 
  3.34  645.021, subdivision 3.
