  1.9             subdivision 4; Minnesota Rules, parts 7011.0400; 
  1.10            7011.0405; 7011.0410; 7100.0300; 7100.0310; 7100.0320; 
  1.11            7100.0330; 7100.0335; 7100.0340; and 7100.0350.  
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Minnesota Statutes 1994, section 115B.22, 
  1.14  subdivision 3a, is amended to read: 
  1.15     Subd. 3a.  [QUANTITY TAX.] (a) The quantity tax does not 
  1.16  apply to very small quantity generators, as defined in the rules 
  1.17  of the agency.  The quantity tax is determined as provided in 
  1.18  paragraphs (b) to (d). 
  1.19     (b) Generators of hazardous waste managed using either of 
  1.20  the following methods as defined in rules adopted under sections 
  1.21  115.03, and 116.07, and 116.37 shall pay taxes on the waste at 
  1.22  the rate of 1.5 cents per pound of solid or 15 cents per gallon 
  1.23  of liquid: 
  1.24     (1) hazardous wastes that are hazardous prior to discharge 
  1.25  to a publicly owned wastewater treatment works; and 
  1.26     (2) hazardous wastes managed as a hazardous waste fuel or 
  1.27  using thermal treatment. 
  1.28     (c) Generators of hazardous waste managed using any of the 
  2.1   following methods as defined in rules adopted under sections 
  2.2   115.03, and 116.07, and 116.37 are exempt from paying taxes on 
  2.3   the wastes: 
  2.4      (1) hazardous wastes that are destined for recycling, 
  2.5   including waste accumulated, stored, or treated prior to 
  2.6   recycling; 
  2.7      (2) hazardous waste that is destined for incineration at a 
  2.8   permitted hazardous waste incineration facility in Minnesota; 
  2.9      (3) hazardous wastes that are either (i) pretreated to a 
  2.10  nonhazardous state prior to discharge to a publicly owned 
  2.11  treatment works, or (ii) treated to a nonhazardous state after 
  2.12  treatment in an on-site treatment system, if the publicly owned 
  2.13  treatment works or on-site treatment system is operated in 
  2.14  accordance with a national pollution discharge elimination 
  2.15  system permit, state disposal system permit, or both, issued by 
  2.16  the agency; and 
  2.17     (4) hazardous wastes that are neutralized and are not 
  2.18  otherwise hazardous waste after neutralizing. 
  2.19     (d) Generators of hazardous waste shall pay taxes on 
  2.20  hazardous wastes managed using any other method not mentioned in 
  2.21  this subdivision at the rate of three cents per pound of solid 
  2.22  or 30 cents per gallon of liquid. 
  2.23     Sec. 2.  Minnesota Statutes 1994, section 116.36, 
  2.24  subdivision 1, is amended to read: 
  2.25     Subdivision 1.  [APPLICABILITY.] For the purposes of 
  2.26  sections 116.36 to section 116.38, the following terms have term 
  2.27  has the meanings meaning given.

  7.7      Sec. 4.  Minnesota Rules, part 7035.2835, subpart 3, is 
  7.8   amended to read: 
  7.9      Subp. 3.  Operation requirements for a yard waste compost 
  7.10  facility. 
  7.11     A.  Odors emitted from the facility must not exceed the 
  7.12  limits specified in parts 7011.0100 to 7011.0115, 7011.0300 
  7.13  to 7011.0410 7011.0330, 7011.1500 to 7011.1515, 7011.1600 to 
  7.14  7011.1625, 7011.2200 to 7011.2220, 7011.2300, and 7023.0100 to 
  7.15  7023.0120. 
  7.16     B.  Composted yard waste offered for use must be produced 
  7.17  by a process that encompasses turning of the yard waste on a 
  7.18  periodic basis to aerate the yard waste, maintain temperatures, 
  7.19  and reduce pathogens.  The composted yard waste must contain no 
  7.20  sharp objects greater than one inch in diameter. 
  7.21     C.  By-products, including residuals and recyclables, must 
  7.22  be stored in a manner that prevents vector problems and 
  7.23  aesthetic degradation.  Materials that are not composted must be 
  7.24  stored and removed at least weekly. 
  7.25     D.  Surface water drainage must be controlled to prevent 
  7.26  leachate runoff.  Surface water drainage must be diverted from 
  7.27  the compost and storage areas. 
  7.28     E.  The annual report required under part 7035.2585 must be 
  7.29  submitted to the commissioner and must include the type and 
  7.30  quantity, by weight or volume, of yard waste received at the 
  7.31  compost facility; the quantity, by weight or volume, of compost 
  7.32  produced; the quantity, by weight or volume, of compost removed 
  7.33  from the facility; and a description of the end-product 
  7.34  distribution and disposal system. 
  7.35     Sec. 5.  [REPEALER.] 
  7.36     Minnesota Statutes 1994, sections 116.36, subdivisions 2, 
  8.1   3, and 5; 116.37; and 116.98, subdivision 4; Minnesota Rules, 
  8.2   parts 7011.0400; 7011.0405; 7011.0410; 7100.0300; 7100.0310; 
  8.3   7100.0320; 7100.0330; 7100.0335; 7100.0340; and 7100.0350, are 
  8.4   repealed.
