  1.1                          A bill for an act
  1.2             relating to education; amending the distribution 
  1.3             formula for library grants; appropriating money; 
  1.4             amending Minnesota Statutes 1996, section 134.35. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 134.35, is 
  1.7   amended to read: 
  1.8      134.35 [REGIONAL LIBRARY BASIC SYSTEM SUPPORT GRANTS; 
  1.9   DISTRIBUTION FORMULA.] 
  1.10     Subdivision 1.  [GRANT APPLICATION.] Any regional public 
  1.11  library system which qualifies according to the provisions of 
  1.12  section 134.34 may apply for an annual grant for regional 
  1.13  library basic system support.  Regional public library districts 
  1.14  under section 134.201 may not compensate board members using 
  1.15  grant funds.  The amount of each grant for each fiscal year 
  1.16  shall be calculated as provided in this section. 
  1.17     Subd. 2.  Fifty-seven and one-half Fifty-three percent of 
  1.18  the available grant funds shall be distributed to provide all 
  1.19  qualifying systems an equal amount per capita.  Each system's 
  1.20  allocation pursuant to this subdivision shall be based on the 
  1.21  population it serves. 
  1.22     Subd. 3.  Twelve and one-half Ten percent of the available 
  1.23  grant funds shall be distributed to provide all qualifying 
  1.24  systems an equal amount per square mile.  Each system's 
  1.25  allocation pursuant to this subdivision shall be based on the 
  2.1   area it serves. 
  2.2      Subd. 4.  Five percent of the available grant funds shall 
  2.3   be paid to each system as a base grant for basic system services.
  2.4      Subd. 5.  Twenty-five Thirty-two percent of the available 
  2.5   grant funds shall be distributed to regional public library 
  2.6   systems based upon the adjusted net tax capacity per capita for 
  2.7   each member county or participating portion of a county as 
  2.8   calculated for the second year preceding the fiscal year for 
  2.9   which the grant is made.  Each system's entitlement shall be 
  2.10  calculated as follows: 
  2.11     (a) Multiply the average of the adjusted net tax capacity 
  2.12  per capita for the current year and two preceding years for each 
  2.13  county or participating portion of a county by .0082. 
  2.14     (b) Add sufficient grant funds that are available under 
  2.15  this subdivision to raise the amount of the county or 
  2.16  participating portion of a county with the lowest value 
  2.17  calculated according to paragraph (a) to the amount of the 
  2.18  county or participating portion of a county with the next 
  2.19  highest value calculated according to paragraph (a).  Multiply 
  2.20  the amount of the additional grant funds by the population of 
  2.21  the county or participating portion of a county. 
  2.22     (c) Continue the process described in paragraph (b) by 
  2.23  adding sufficient grant funds that are available under this 
  2.24  subdivision to the amount of a county or participating portion 
  2.25  of a county with the next highest value calculated in paragraph 
  2.26  (a) to raise it and the amount of counties and participating 
  2.27  portions of counties with lower values calculated in paragraph 
  2.28  (a) up to the amount of the county or participating portion of a 
  2.29  county with the next highest value, until reaching an amount 
  2.30  where funds available under this subdivision are no longer 
  2.31  sufficient to raise the amount of a county or participating 
  2.32  portion of a county and the amount of counties and participating 
  2.33  portions of counties with lower values up to the amount of the 
  2.34  next highest county or participating portion of a county. 
  2.35     (d) If the point is reached using the process in paragraphs 
  2.36  (b) and (c) at which the remaining grant funds under this 
  3.1   subdivision are not adequate for raising the amount of a county 
  3.2   or participating portion of a county and all counties and 
  3.3   participating portions of counties with amounts of lower value 
  3.4   to the amount of the county or participating portion of a county 
  3.5   with the next highest value, those funds are to be divided on a 
  3.6   per capita basis for all counties or participating portions of 
  3.7   counties that received grant funds under the calculation in 
  3.8   paragraphs (b) and (c). 
  3.9      Subd. 6.  [POPULATION DETERMINATION.] Population shall be 
  3.10  determined according to section 477A.011, subdivision 3. 
  3.11     Sec. 2.  [APPROPRIATIONS.] 
  3.12     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  3.13  LEARNING.] The sums indicated in this section are appropriated 
  3.14  from the general fund to the department of children, families, 
  3.15  and learning for the fiscal years designated.  
  3.16     Subd. 2.  [BASIC SUPPORT GRANTS.] For basic support grants 
  3.17  according to Minnesota Statutes, sections 134.32 to 134.35: 
  3.18       $12,481,000     .....     1998 
  3.19       $13,000,000     .....     1999 
  3.20     The 1998 appropriation includes $781,000 for 1997 and 
  3.21  $11,700,000 for 1998.  
  3.22     The 1999 appropriation includes $1,300,000 for 1998 and 
  3.23  $11,700,000 for 1999.
