  1.1                          A bill for an act 
  1.2             relating to school transportation; allowing licensed 
  1.3             school district employees, coaches, and advisors to 
  1.4             drive certain school buses to and from school-related 
  1.5             activities; amending Minnesota Statutes 2000, section 
  1.6             171.321, subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 171.321, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [ENDORSEMENT.] No person shall drive a 
  1.11  school bus when transporting school children to or from school 
  1.12  or upon a school-related trip or activity without having a valid 
  1.13  class A, class B, or class C driver's license with a school bus 
  1.14  endorsement except that: 
  1.15     (1) a person possessing a valid driver's license but not a 
  1.16  school bus endorsement may drive a vehicle with a seating 
  1.17  capacity of ten or less fewer persons used as a school bus but 
  1.18  not outwardly equipped or identified as a school bus.; and 
  1.19     (2) with respect to transportation between school and an 
  1.20  extracurricular event or the community in which the event is 
  1.21  held, a person possessing a valid driver's license but not a 
  1.22  school bus endorsement may drive a type A-II school bus as 
  1.23  defined in section 169.01, subdivision 6, having a seating 
  1.24  capacity of 15 or fewer, including the driver, if that person is 
  1.25  employed by the school district and licensed by the department 
  1.26  of children, families, and learning, or board of teaching, or is 
  2.1   retained by the district as a coach or advisor for the 
  2.2   extracurricular event for which the transportation is provided.  
  2.3   A driver described in this clause may not operate the stop 
  2.4   signal arm, prewarning flashing amber signals, and flashing red 
  2.5   signals.  A district that provides transportation under this 
  2.6   clause must refer to this clause in its comprehensive policy 
  2.7   under section 123B.91 and must maintain a driver qualification 
  2.8   file for each driver to ensure proper licensure and 
  2.9   qualification under subdivision 4.  Section 169A.20, subdivision 
  2.10  1, clause (6), applies to a driver under this section.
