  1.1                          A bill for an act 
  1.2             relating to consumer protection; prohibiting the 
  1.3             advertisement of misleading business names or 
  1.4             telephone numbers; amending Minnesota Statutes 1998, 
  1.5             section 325F.69, subdivision 3, and by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 325F.69, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [ADVERTISING MEDIA EXCLUDED.] Sections 325F.68 to 
  1.11  325F.70 shall apply to actions of the owner, publisher, agent or 
  1.12  employee of newspapers, magazines, other printed matter or radio 
  1.13  or television stations or other advertising media used for the 
  1.14  publication or dissemination of an advertisement, only if the 
  1.15  owner, publisher, agent, or employee has either knowledge of the 
  1.16  false, misleading or deceptive character of the advertisement or 
  1.17  a financial interest in the sale or distribution of the 
  1.18  advertised merchandise.  This subdivision applies to the 
  1.19  publisher of a telephone directory for the purposes of the 
  1.20  publication of a deceptive directory listing under subdivision 6.
  1.21     Sec. 2.  Minnesota Statutes 1998, section 325F.69, is 
  1.22  amended by adding a subdivision to read: 
  1.23     Subd. 6.  [DECEPTIVE TELEPHONE DIRECTORY LISTINGS.] No 
  1.24  person shall cause or knowingly permit the publication of any 
  1.25  telephone directory listing that is likely to create confusion 
  1.26  as to the geographical location of a place of business because 
  2.1   of the business name or telephone number used in the listing.
