  1.1                          A bill for an act
  1.2             relating to highways; requiring commissioner of 
  1.3             transportation's rules for operation of I-394 parking 
  1.4             ramp in Minneapolis to provide incentives for use of 
  1.5             the ramp by high-occupancy vehicles that use highways 
  1.6             other than I-394; amending Minnesota Statutes 1994, 
  1.7             section 161.1231, subdivision 2, and by adding a 
  1.8             subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 161.1231, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [RULES AND PROCEDURES.] The commissioner shall 
  1.13  adopt rules and establish procedures for the operation and use 
  1.14  of the parking facilities.  The rules are exempt from the 
  1.15  requirements of chapter 14.  A copy of the rules that regulate 
  1.16  use of the facilities by drivers must be posted in each parking 
  1.17  facility.  The rules must: 
  1.18     (1) establish incentives, which must include preferential 
  1.19  parking locations, to encourage drivers of high-occupancy 
  1.20  vehicles that travel I-394 and that are occupied by two or more 
  1.21  persons to use the facilities; 
  1.22     (2) establish incentives, which must include preferential 
  1.23  parking locations to the extent feasible after satisfying the 
  1.24  requirement of clause (1), to encourage drivers of 
  1.25  high-occupancy vehicles that travel highways other than I-394; 
  1.26     (3) define peak travel hours and provide that during peak 
  1.27  travel hours single-occupant vehicles be charged a surcharge to 
  2.1   bring the parking fee for those vehicles to approximately the 
  2.2   same level as parking fees charged in the private parking ramps 
  2.3   located in Minneapolis; 
  2.4      (3) (4) provide preferential parking locations, to the 
  2.5   extent feasible after satisfying the requirements of clause (1), 
  2.6   for vehicles licensed and operated under section 168.021; 
  2.7      (4) (5) establish application, permit, and use 
  2.8   requirements; and 
  2.9      (5) (6) provide for removal and impoundment of vehicles and 
  2.10  assessment of a service fee on vehicles parked in violation of 
  2.11  this section and the rules adopted under it. 
  2.12     Sec. 2.  Minnesota Statutes 1994, section 161.1231, is 
  2.13  amended by adding a subdivision to read: 
  2.14     Subd. 9a.  [HIGH-OCCUPANCY VEHICLE.] For purposes of this 
  2.15  section "high-occupancy vehicle" means a motor vehicle that is 
  2.16  occupied by two or more persons. 
  2.17     Sec. 3.  [EFFECTIVE DATE.] 
  2.18     Sections 1 and 2 are effective the day following final 
  2.19  enactment.
