  1.1                          A bill for an act 
  1.2             relating to state government; providing for the 
  1.3             funding of state mandated programs and procedures; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [3.883] [UNFUNDED MANDATE PROHIBITION.] 
  1.8      Subdivision 1.  [DEFINITION.] As used in this section, 
  1.9   "mandate" means those programs and procedures required by state 
  1.10  law or rule to be financed, delivered, or performed by political 
  1.11  subdivisions.  A mandate includes federal programs to the extent 
  1.12  the state elects to impose them as a mandate on political 
  1.13  subdivisions but does not include federal mandates for which 
  1.14  there is no substantial state discretion. 
  1.15     Subd. 2.  [FUNDING OF THE COST OF MANDATES.] If the fiscal 
  1.16  note prepared by the commissioner of finance under section 
  1.17  3.982, or a state agency estimate of cost, indicates that a new 
  1.18  or expanded mandate on a political subdivision imposed either in 
  1.19  a bill introduced in the legislature, or in a new or expanded 
  1.20  state agency rule, will impose a statewide cost on counties or 
  1.21  on school districts in excess of $1,000,000 or a statewide cost 
  1.22  on cities, however organized, or on towns in excess of $500,000, 
  1.23  the political subdivisions are not required to implement the 
  1.24  mandate unless the legislature, by appropriation enacted before 
  1.25  the mandate is required to be implemented, provides 
  2.1   reimbursement to the political subdivisions for the costs 
  2.2   incurred.
