  1.1                          A bill for an act 
  1.2             relating to education; providing for the reporting of 
  1.3             tobacco use by students; amending Minnesota Statutes 
  1.4             1996, sections 126.036; and 126.037, subdivision 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 126.036, is 
  1.7   amended to read: 
  1.8      126.036 [LAW ENFORCEMENT RECORDS.] 
  1.9      A law enforcement agency shall provide notice of any drug 
  1.10  incident occurring within the agency's jurisdiction, in which 
  1.11  the agency has probable cause to believe a student violated 
  1.12  section 152.021, 152.022, 152.023, 152.024, 152.025, 152.027, 
  1.13  152.097, or 340A.503, subdivision 1, 2, or 3, or 609.685, 
  1.14  subdivision 3.  The notice shall be in writing and shall be 
  1.15  provided, within two weeks after an incident occurs, to the 
  1.16  chemical abuse preassessment team in the school where the 
  1.17  student is enrolled. 
  1.18     Sec. 2.  Minnesota Statutes 1996, section 126.037, 
  1.19  subdivision 1, is amended to read: 
  1.20     Subdivision 1.  [TEACHER'S DUTY.] A teacher in a nonpublic 
  1.21  school participating in a school district chemical use program, 
  1.22  or a public school teacher, who knows or has reason to believe 
  1.23  that a student is using, possessing, or transferring alcohol, 
  1.24  tobacco, or a controlled substance while on the school premises 
  1.25  or involved in school-related activities, shall immediately 
  2.1   notify the school's chemical abuse preassessment team of this 
  2.2   information.  A teacher who complies with this section shall be 
  2.3   defended and indemnified under section 466.07, subdivision 1, in 
  2.4   any action for damages arising out of the compliance.
