  1.1                          A bill for an act 
  1.2             relating to occupations; authorizing certification of 
  1.3             asbestos air monitoring professionals; amending 
  1.4             Minnesota Statutes 1996, sections 326.71, by adding a 
  1.5             subdivision; and 326.73, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 326.71, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 2a.  [ASBESTOS AIR MONITORING 
  1.10  PROFESSIONAL.] "Asbestos air monitoring professional" means an 
  1.11  individual who is responsible for collecting air samples 
  1.12  required during asbestos-related work.  
  1.13     Sec. 2.  Minnesota Statutes 1996, section 326.73, is 
  1.14  amended by adding a subdivision to read: 
  1.15     Subd. 5.  [ASBESTOS AIR MONITORING PROFESSIONAL.] (a) 
  1.16  Before an individual performs air monitoring for asbestos, the 
  1.17  individual shall obtain a certificate from the commissioner.  
  1.18  The commissioner shall issue an air monitoring professional 
  1.19  certificate to an individual who has shown evidence of 
  1.20  completion of a two-day air sampling course and an asbestos 
  1.21  contractor/site supervisor course approved by the commissioner 
  1.22  and who has passed an examination in these subjects.  The 
  1.23  certificate issued by the commissioner shall be in writing, be 
  1.24  dated when issued, contain an expiration date, be signed by the 
  1.25  commissioner, and contain the name and address of the individual 
  2.1   to whom it is issued. 
  2.2      (b) An air monitoring professional shall obtain baseline, 
  2.3   area, personal, and clearance samples and any other air sample 
  2.4   necessary for asbestos-related work; collect air samples as 
  2.5   specified by appropriate sampling procedures; collect air 
  2.6   samples in the number, location, and frequency necessary to 
  2.7   adequately reflect airborne levels of fibers in compliance with 
  2.8   rules; use appropriate sampling techniques during area clearance 
  2.9   sampling; conduct air monitoring duties in an impartial, 
  2.10  unbiased manner; and report monitoring results accurately.  An 
  2.11  air monitoring professional may perform analysis of air samples 
  2.12  for asbestos fibers in the field only if that person has 
  2.13  completed an approved National Institute for Occupational Safety 
  2.14  and Health 582 or equivalency course as approved by the 
  2.15  commissioner.
