  1.1                          A bill for an act
  1.2             relating to transportation; appropriating $10,000,000 
  1.3             to the commissioner of transportation for port 
  1.4             development assistance; increasing the share of port 
  1.5             development project costs that may be paid by the 
  1.6             commissioner; specifying who may apply for grants and 
  1.7             loans; amending Minnesota Statutes 1994, sections 
  1.8             457A.02, subdivision 2; and 457A.03, subdivision 3; 
  1.9             repealing Minnesota Statutes 1994, section 457A.01, 
  1.10            subdivision 7. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1994, section 457A.02, 
  1.13  subdivision 2, is amended to read: 
  1.14     Subd. 2.  [COMMISSIONER TO ADMINISTER.] The commissioner 
  1.15  shall administer the port development assistance program to 
  1.16  advance the purposes of subdivision 1.  In administering the 
  1.17  program, the commissioner may: 
  1.18     (1) make grants and loans to persons applicants eligible 
  1.19  under section 457A.03, subdivision 1, to apply for them; 
  1.20     (2) make assistance agreements with recipients of grants 
  1.21  and loans; and 
  1.22     (3) adopt rules authorized by section 457A.05. 
  1.23     Sec. 2.  Minnesota Statutes 1994, section 457A.03, 
  1.24  subdivision 3, is amended to read: 
  1.25     Subd. 3.  [STATE PARTICIPATION; LIMITATIONS.] The 
  1.26  commissioner may not provide any assistance under this chapter 
  1.27  for more than 50 80 percent of the nonfederal share of any 
  1.28  project.  Assistance provided under this chapter may not be used 
  2.1   to match any other state funds.  The commissioner shall not 
  2.2   assume continuing funding responsibility for any commercial 
  2.3   navigation facility project. 
  2.4      Sec. 3.  [APPROPRIATION.] 
  2.5      $10,000,000 is appropriated from the general fund to the 
  2.6   commissioner of transportation for the purpose of the port 
  2.7   development assistance program under Minnesota Statutes, chapter 
  2.8   457A.  This appropriation is available until spent. 
  2.9      Sec. 4.  [REPEALER.] 
  2.10     Minnesota Statutes 1994, section 457A.01, subdivision 7, is 
  2.11  repealed. 
  2.12     Sec. 5.  [EFFECTIVE DATE.] 
  2.13     Sections 1 to 4 are effective the day following final 
  2.14  enactment.
