A bill for an act
relating to public safety; requiring the reporting of lost or stolen firearms;
providing criminal penalties; proposing coding for new law in Minnesota
Statutes, chapter 609.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Duty to report. new text end

new text begin (a) Any person who possesses a firearm, as defined
in section 609.666, that is subsequently stolen from the person or that the person loses
shall report the theft or loss within 72 hours to the law enforcement agency having primary
jurisdiction over the location where the theft or loss occurred.

new text begin (b) The law enforcement agency shall forward a copy of the report to the
commissioner of public safety.

new text begin (a) A person who knows or had reason to know of the
firearm's theft or loss and who does not comply with subdivision 1, paragraph (a), is guilty
of a misdemeanor. If the person has previously been convicted of violating subdivision 1,
paragraph (a), the person is guilty of a gross misdemeanor.

new text begin (b) A person who violates paragraph (a) by intentionally failing to comply with
subdivision 1, paragraph (a), is guilty of a gross misdemeanor. If the person has previously
been convicted of violating subdivision 1, paragraph (a), the person is guilty of a felony
and may be sentenced to imprisonment for not more than two years or to payment of
a fine of not more than $5,000, or both.
