  1.1                          A bill for an act 
  1.2             relating to information practices; requiring the 
  1.3             commissioner of administration to establish an 
  1.4             information policy training program; appropriating 
  1.5             money; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 13. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [13.073] [PUBLIC INFORMATION POLICY TRAINING 
  1.9   PROGRAM.] 
  1.10     Subdivision 1.  [ESTABLISHMENT.] The commissioner shall 
  1.11  establish a program for training state and local government 
  1.12  officials and employees on public information policy, including 
  1.13  government data practices laws and official records and records 
  1.14  management statutes.  The program must provide for the 
  1.15  development of broad-based expertise within state and local 
  1.16  government entities.  The program components must include basic 
  1.17  training, specific training for specialized service sectors, and 
  1.18  policy analysis and support. 
  1.19     Subd. 2.  [GENERAL PROVISIONS.] The commissioner shall 
  1.20  publicize the development and implementation of the training 
  1.21  program under this section and shall seek input from state and 
  1.22  local government entities in a variety of sectors.  The 
  1.23  commissioner shall prepare a training guide that includes an 
  1.24  overview of the training program and its components. 
  1.25     Subd. 3.  [BASIC TRAINING.] The basic training component 
  1.26  must be designed to meet the basic information policy needs of 
  2.1   all government employees and public officials, with a focus on 
  2.2   key data practices laws and procedures that apply to all 
  2.3   government entities.  The commissioner shall design the basic 
  2.4   training component in a manner that minimizes duplication of 
  2.5   effort and cost for government entities providing basic 
  2.6   training.  The commissioner shall develop general programs and 
  2.7   materials for basic training, such as video presentations and 
  2.8   data practices booklets and training guides.  The commissioner 
  2.9   shall facilitate state and local government agencies in 
  2.10  developing training expertise within their own agencies and 
  2.11  conduct periodic training sessions for this purpose. 
  2.12     Subd. 4.  [SECTOR-SPECIFIC TRAINING.] (a) The 
  2.13  sector-specific training component must be designed to provide 
  2.14  for the development of specific expertise needed to deal with 
  2.15  information policy issues within a particular service area.  
  2.16  Service areas may include state agencies, counties, cities, 
  2.17  school districts, higher education agencies, human service 
  2.18  agencies, and law enforcement agencies.  This component must 
  2.19  focus on training individuals with significant responsibility 
  2.20  for implementing data practices and other information policy 
  2.21  laws within their government entity. 
  2.22     (b) The commissioner shall provide technical assistance and 
  2.23  support and help coordinate efforts to develop sector-specific 
  2.24  training within different sectors.  Elements of sector-specific 
  2.25  training must include: 
  2.26     (1) designation, training, and coordination of data 
  2.27  practices specialists with responsibility for clarification and 
  2.28  resolution of sector-specific information policy problems; 
  2.29     (2) development of telephone hot lines within different 
  2.30  sectors for handling information policy inquiries; and 
  2.31     (3) development of forums under which individuals with 
  2.32  ongoing information policy administrative responsibilities may 
  2.33  meet to discuss issues arising within their sectors. 
  2.34     Subd. 5.  [POLICY ANALYSIS AND SUPPORT.] The policy 
  2.35  analysis and support component must be designed to address 
  2.36  information policy issues at the policy level and to provide 
  3.1   ongoing consultation and support regarding major areas of 
  3.2   concern, with a goal of developing a coherent and coordinated 
  3.3   approach to information policy within the state.  The 
  3.4   commissioner shall facilitate the development and implementation 
  3.5   of information policy and provide a clearinghouse for ideas, 
  3.6   information, and resources. 
  3.7      Subd. 6.  [GRANTS.] The commissioner may make grants to 
  3.8   political subdivisions for purposes of supplementing and 
  3.9   encouraging local government efforts under this section. 
  3.10     Sec. 2.  [REPORT.] 
  3.11     By January 1, 1997, the commissioner shall report to the 
  3.12  legislature on the implementation of the training program under 
  3.13  section 1.  The report must include an analysis of the 
  3.14  effectiveness of the program in improving information policy 
  3.15  practices and recommendations for any changes in the program. 
  3.16     Sec. 3.  [APPROPRIATION.] 
  3.17     $....... is appropriated from the general fund to the 
  3.18  commissioner of administration for purposes of developing the 
  3.19  training program under section 1 and making grants under section 
  3.20  1, subdivision 6.
