  1.1                          A bill for an act 
  1.2             relating to retirement; public employees retirement 
  1.3             association general plan; authorizing a Bemidji city 
  1.4             council member to terminate plan coverage. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [BEMIDJI CITY COUNCIL MEMBER TERMINATION OF 
  1.7   PENSION COVERAGE.] 
  1.8      (a) Notwithstanding any provision of Minnesota Statutes, 
  1.9   chapter 353 or 353D to the contrary, an eligible individual 
  1.10  described in paragraph (b) is authorized to terminate public 
  1.11  employees retirement association general plan coverage as 
  1.12  specified in paragraph (c). 
  1.13     (b) An eligible individual is an individual who: 
  1.14     (1) was employed as a Beltrami county employee and became a 
  1.15  member of the public employees retirement association general 
  1.16  plan due to that service on June 1, 1991; 
  1.17     (2) was elected to the Bemidji city council and took office 
  1.18  in January 2001; 
  1.19     (3) elected under law then applicable to have public 
  1.20  employees retirement association general plan coverage for the 
  1.21  city council elected service; and 
  1.22     (4) terminated Beltrami county employment but is unable to 
  1.23  commence receipt of a public employees retirement association 
  1.24  general plan annuity because of the continuing public employees 
  1.25  retirement association general plan coverage for the elected 
  2.1   city council service. 
  2.2      (c) As of the effective date of this act, the election of 
  2.3   public employees retirement association general plan coverage 
  2.4   for the elected city council service by an eligible individual 
  2.5   under paragraph (b) is voided, and for purposes of the plan the 
  2.6   eligible individual is considered to have terminated covered 
  2.7   service as of that date. 
  2.8      Sec. 2.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective on the day following final enactment.
