  1.1                          A bill for an act 
  1.2             relating to motor vehicles; modifying filing fee for 
  1.3             vehicle transactions; making clarifying changes; 
  1.4             amending Minnesota Statutes 2000, section 168.33, 
  1.5             subdivision 7. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 168.33, 
  1.8   subdivision 7, is amended to read: 
  1.9      Subd. 7.  [FILING FEE.] (a) In addition to all other 
  1.10  statutory fees and taxes, a filing fee of $3.50 is imposed on 
  1.11  every application: 
  1.12     (i) $3.50 is imposed on every application made directly to 
  1.13  the department; 
  1.14     (ii) $4.50 is imposed on every motor vehicle registration 
  1.15  renewal, excluding pro rate, made to a public or private deputy 
  1.16  registrar; and 
  1.17     (iii) $7 is imposed on every other type of vehicle 
  1.18  transaction, including pro rate, made to a public or private 
  1.19  deputy registrar; 
  1.20  except that a filing fee may not be charged for a document 
  1.21  returned for a refund or for a correction of an error made by 
  1.22  the department of public safety, a licensed auto dealer, or a 
  1.23  deputy registrar.  The filing fee shall must be shown as a 
  1.24  separate item on all registration renewal notices sent out by 
  1.25  the department of public safety.  No filing fee or other fee may 
  2.1   be charged for the permanent surrender of a certificate of title 
  2.2   and license plates for a motor vehicle.  
  2.3      (b) Filing fees collected under this subdivision by the 
  2.4   registrar department must be paid into the state treasury and 
  2.5   credited to the highway user tax distribution fund, except fees 
  2.6   for registrations of motor vehicles.  Filing fees collected for 
  2.7   registrations of motor vehicles in conjunction with a title 
  2.8   transfer or first application in this state must be paid into 
  2.9   the state treasury with 50 percent of the money credited to the 
  2.10  general fund and 50 percent credited to the highway user tax 
  2.11  distribution fund. 
  2.12     (c) A motor vehicle dealer shall retain $2.50 of each 
  2.13  filing fee imposed under this subdivision for a completed 
  2.14  transaction involving the sale of a motor vehicle to or by a 
  2.15  licensed dealer, if the dealer electronically transmits the 
  2.16  transaction to the department or deputy registrar.  The 
  2.17  department shall develop procedures to implement this 
  2.18  subdivision in consultation with Minnesota Deputy Registrar 
  2.19  Association and Minnesota Automobile Dealers Association.  
  2.20  Deputy registrars shall not be prohibited from receiving and 
  2.21  processing required documents supporting an electronic 
  2.22  transaction.
