  1.1                          A bill for an act 
  1.2             relating to state government; appointments of members 
  1.3             of administrative boards and agencies; clarifying 
  1.4             procedures and requirements; amending Minnesota 
  1.5             Statutes 1996, section 15.0575, subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 15.0575, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [REMOVAL; VACANCIES.] A member may be removed by 
  1.10  the appointing authority at any time (1) for cause, after notice 
  1.11  and hearing, or (2) after missing three consecutive meetings.  
  1.12  The chair of the board shall inform the appointing authority of 
  1.13  a member missing the three consecutive meetings.  After the 
  1.14  second consecutive missed meeting and before the next meeting, 
  1.15  the secretary of the board shall notify the member in writing 
  1.16  that the member may be removed for missing the next meeting.  In 
  1.17  the case of a vacancy on the board, the appointing authority 
  1.18  shall appoint, subject to the advice and consent of the senate 
  1.19  if the member is appointed by the governor, a person to fill the 
  1.20  vacancy for the remainder of the unexpired term.  An appointment 
  1.21  to fill a vacancy is subject to the advice and consent of the 
  1.22  senate if the appointment of the person whose position is vacant 
  1.23  was subject to the advice and consent of the senate.
