  1.1                          A bill for an act
  1.2             relating to crime; increasing penalties for fleeing a 
  1.3             peace officer in a motor vehicle; amending Minnesota 
  1.4             Statutes 1996, section 609.487, subdivision 3. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 609.487, 
  1.7   subdivision 3, is amended to read: 
  1.8      Subd. 3.  [FLEEING AN OFFICER.] Whoever by means of a motor 
  1.9   vehicle flees or attempts to flee a peace officer who is acting 
  1.10  in the lawful discharge of an official duty, and the perpetrator 
  1.11  knows or should reasonably know the same to be a peace 
  1.12  officer, may be sentenced to imprisonment for not more than one 
  1.13  year or to payment of a fine of not more than $3,000, or both.  
  1.14  Whoever violates this subdivision a second or subsequent time is 
  1.15  guilty of a felony and may be sentenced to imprisonment for not 
  1.16  more than one year three years and one day or to payment of a 
  1.17  fine of not more than $3,000 $5,000, or both. 
  1.18     Sec. 2.  [EFFECTIVE DATE.] 
  1.19     Section 1 is effective August 1, 1997, and applies to 
  1.20  crimes committed on or after that date.
