  1.1                          A bill for an act 
  1.2             relating to emergency snow removal; providing for 
  1.3             private assistance and assumption of liability 
  1.4             associated with the assistance; amending Minnesota 
  1.5             Statutes 1996, section 160.21, subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 160.21, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [EMERGENCY SNOW REMOVAL.] Any road authority 
  1.10  including road authorities of cities may remove snow from any 
  1.11  road or highway in cases of emergency.  Any road authority may 
  1.12  enlist the assistance of private citizens and their equipment 
  1.13  for the purpose of emergency snow removal.  Notwithstanding 
  1.14  subdivision 5, private citizens assisting in emergency snow 
  1.15  removal shall not be considered employees, contractors, or 
  1.16  agents of the road authority.  Cities, counties, and towns are 
  1.17  not liable for damages arising from the assistance of private 
  1.18  citizens and their equipment for emergency snow removal.  To the 
  1.19  extent a city, county, or town would be so liable if the damages 
  1.20  had been caused by its equipment or employee, the state assumes 
  1.21  liability.
