  1.1                          A bill for an act 
  1.2             relating to education; permitting developers of new 
  1.3             housing to pay a school impact fee; amending Minnesota 
  1.4             Statutes 1994, section 462.358, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 462.358, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 2c.  [IMPACT FEES; SCHOOLS.] The regulations may 
  1.10  require a developer of new housing to pay a school impact fee.  
  1.11  The fee may be based on a per unit of housing or as a percent of 
  1.12  the value of the house, including real estate, located in the 
  1.13  development.  The municipality must transfer the money to the 
  1.14  school district in which the development is located within 15 
  1.15  business days following receipt.  If the development is located 
  1.16  in more than one school district, the municipality must transfer 
  1.17  the money to each school district in proportion to the housing 
  1.18  units contained in each district.  This apportionment must use 
  1.19  either value or actual units, whichever was used in determining 
  1.20  the original fee.
