A bill for an act
relating to insurance; requiring that health plans that include out-of-network
coverage permit assignment of benefits; proposing coding for new law in
Minnesota Statutes, chapter 62Q.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) For purposes of this section, the terms defined in
this subdivision have the meanings given.

(b) "Point-of-service option" has the meaning given in section 62Q.51, subdivision 1.

(c) "Assignment of benefits" means a provision in a health plan that permits the
insured or other covered person to assign to a health care provider the right to submit
a claim to the health plan company for payment, subject to any applicable enrollee
cost-sharing.

A health plan
that provides coverage for care received outside of the health plan's provider network
must permit enrollees to assign benefits to the out-of-network provider that provided
the out-of-network care.

This section is effective for health plans offered, issued,
or renewed on or after January 1, 2012.
