A bill for an act
relating to watershed districts; eliminating eminent domain powers of watershed
districts; amending Minnesota Statutes 2020, section 103D.335, subdivisions 1,
11.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 103D.335, subdivision 1, is amended to read:


Subdivision 1.

General powers.

A watershed district has the power, to the extent
necessary for lawful conservation purposes:

(1) to sue and be sued;

(2) to incur debts, liabilities, and obligations;

Sec. 2.

Minnesota Statutes 2020, section 103D.335, subdivision 11, is amended to read:


Subd. 11.

Acquiring property.

The managers may acquire by gift, purchase, new text begin or new text end taking
under the procedures of this chapterdeleted text begin , or by the power of eminent domain,deleted text end necessary real
and personal property. The watershed district may acquire property outside the watershed
district where necessary for a water supply system.
