1.1 A bill for an act
1.2 relating to liquor; authorizing the cities of
1.3 Minneapolis, St. Paul, Rochester, Bloomington, St.
1.4 Cloud, and Duluth to adopt ordinances authorizing
1.5 on-sales at hotels during certain hours; exempting
  1.6             certain sales from on-sale hours restrictions;
1.7 amending Minnesota Statutes 2000, section 340A.504, by
  1.8 adding subdivisions.
1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
  1.10 Section 1. Minnesota Statutes 2000, section 340A.504, is
1.11 amended by adding a subdivision to read:
1.12 Subd. 2a. [CERTAIN DISPENSING EXEMPT.] Where a hotel
1.13 possessing an on-sale intoxicating liquor license places
1.14 containers of intoxicating liquor in cabinets in hotel rooms for
1.15 the use of guests staying in those hotel rooms, and a charge is
1.16 made for withdrawals from those cabinets, the dispensing of
1.17 intoxicating liquor from those cabinets does not constitute a
1.18 sale for purposes of subdivision 2.
  1.19 Sec. 2. Minnesota Statutes 2000, section 340A.504, is
1.20 amended by adding a subdivision to read:
1.21 Subd. 7. [EXTENDED HOURS FOR ON-SALE.] Notwithstanding
1.22 subdivision 2, the cities of Minneapolis, St. Paul, Rochester,
1.23 Bloomington, St. Cloud, and Duluth may enact an ordinance that
1.24 authorizes the issuance of on-sale intoxicating liquor licenses
1.25 that permit a hotel licensee to make on-sales of intoxicating
  1.26 liquor between the hours of 1:00 a.m. and 2:00 a.m. Monday
1.27 through Friday and between the hours of 1:00 a.m. and 2:30 a.m.
2.1 on Saturday and Sunday. An ordinance may not limit licenses
2.2 issued under this paragraph to a particular geographic area of
2.3 the city. The city enacting the ordinance may issue a temporary
2.4 permit to a hotel licensee that authorizes the hotel to sell

  2.6 and 2:00 a.m. Monday through Friday and 1:00 a.m. and 2:30 a.m.
2.7 Saturday and Sunday. Such a temporary permit may only be issued

  2.14 Sec. 3. [EFFECTIVE DATE.]
2.15 Sections 1 and 2 are effective the day following final
