1.1 A bill for an act 1.2 relating to commerce; prohibiting certain business 1.3 practices of those who make certain repairs or 1.4 improvements to real property; proposing coding for 1.5 new law in Minnesota Statutes, chapter 337. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. [337.10] [REPAIRS OR IMPROVEMENTS TO REAL 1.8 PROPERTY; PROHIBITED PRACTICES BY CONTRACTORS.] 1.9 (a) A contractor shall not engage in the conduct in 1.10 paragraph (b) in connection with repairs or improvements that 1.11 are covered by that paragraph. 1.12 (b) The contractor shall not: 1.13 (1) initiate contact with a prospective client between the 1.14 hours of 8:00 p.m. and 8:00 a.m.; 1.15 (2) make a willful or knowing misrepresentation of facts or 1.16 advise a person on questions of law; 1.17 (3) make a willful or knowing false statement about an 1.18 insurance company or its employees, agents, or representatives; 1.19 or 1.20 (4) solicit employment of a client in connection with a 1.21 loss that is the subject of a contract with another contractor. 1.22 For purposes of this section, "contractor" means a person 1.23 who, in the ordinary course of business, repairs or improves 1.24 real property because of loss or damage to the property for 1.25 which a public adjuster licensed under chapter 72B is or may be 2.1 employed.
