  1.1                          A bill for an act 
  1.2             relating to the military; exempting the national guard 
  1.3             and the department of military affairs from certain 
  1.4             prohibitions concerning weapons; limiting the penalty 
  1.5             for certain persons who possess unauthorized pistols 
  1.6             in certain locations; imposing penalties; amending 
  1.7             Minnesota Statutes 1994, section 609.66, subdivisions 
  1.8             1g and 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 609.66, 
  1.11  subdivision 1g, is amended to read: 
  1.12     Subd. 1g.  [FELONY; POSSESSION IN COURTHOUSE OR CERTAIN 
  1.13  STATE BUILDINGS.] (a) A person who commits either of the 
  1.14  following acts is guilty of a felony and may be sentenced to 
  1.15  imprisonment for not more than five years or to payment of a 
  1.16  fine of not more than $10,000, or both: 
  1.17     (1) possesses a dangerous weapon, ammunition, or explosives 
  1.18  within any courthouse complex; or 
  1.19     (2) possesses a dangerous weapon, ammunition, or explosives 
  1.20  in any state building within the capitol area described in 
  1.21  section 15.50, other than the National Guard Armory. 
  1.22     (b) Unless a person is otherwise prohibited or restricted 
  1.23  by other law to possess a dangerous weapon, this subdivision 
  1.24  does not apply to: 
  1.25     (1) licensed peace officers or military personnel who are 
  1.26  performing official duties; 
  1.27     (2) persons who carry pistols according to the terms of a 
  2.1   permit issued under section 624.714 and who so notify the 
  2.2   sheriff or the commissioner of public safety, as appropriate; 
  2.3      (3) persons who possess dangerous weapons for the purpose 
  2.4   of display as demonstrative evidence during testimony at a trial 
  2.5   or hearing or exhibition in compliance with advance notice and 
  2.6   safety guidelines set by the sheriff or the commissioner of 
  2.7   public safety; or 
  2.8      (4) persons who possess dangerous weapons in a courthouse 
  2.9   complex with the express consent of the county sheriff or who 
  2.10  possess dangerous weapons in a state building with the express 
  2.11  consent of the commissioner of public safety. 
  2.12     (c) Notwithstanding paragraph (a), a person who would 
  2.13  otherwise be within the exception described in paragraph (b), 
  2.14  clause (2), who fails to provide the required notice, is guilty 
  2.15  of a petty misdemeanor and may be fined up to $200. 
  2.16     Sec. 2.  Minnesota Statutes 1994, section 609.66, 
  2.17  subdivision 2, is amended to read: 
  2.18     Subd. 2.  [EXCEPTIONS.] Nothing in this section prohibits 
  2.19  the possession of the articles mentioned by museums or 
  2.20  collectors of art or for other lawful purposes of public 
  2.21  exhibition.  The prohibitions of subdivisions 1, paragraph (a), 
  2.22  clause (2), and 1b are not applicable to governmental military 
  2.23  organizations including, but not limited to, the national guard 
  2.24  and the department of military affairs, to the extent these 
  2.25  entities are conducting safe training and recruiting activities 
  2.26  under direct supervision of qualified military personnel.
