1.1 A bill for an act 1.2 relating to agriculture; expanding eligibility for the 1.3 value-added agricultural product loan program; 1.4 amending Minnesota Statutes 1994, section 41B.046, 1.5 subdivision 1, and by adding a subdivision. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1994, section 41B.046, 1.8 subdivision 1, is amended to read: 1.9 Subdivision 1. [DEFINITIONS.] For purposes of this section: 1.10 (1) Agricultural commodity has the meaning given in section 1.11 17.90. 1.12(1)(2) "Agricultural product processing facility" means 1.13 land, buildings, structures, fixtures, and improvements located 1.14 or to be located in Minnesota and used or operated primarily for 1.15 the processing or production of marketable products 1.16 fromagriculture cropsagricultural commodities, including waste 1.17 and residues fromagriculture cropsagricultural commodities, 1.18 but, except as provided in subdivision 4a, not including 1.19 livestock or livestock products, poultry or poultry products, or 1.20 wood or wood products. 1.21(2)(3) "Value-added agricultural product" means a product 1.22 derived from an agriculturalcropscommodity, including waste 1.23 and residues from agriculturalcropscommodities, but, except as 1.24 provided in subdivision 4a, not including livestock or livestock 1.25 products, poultry or poultry products, or wood or wood products, 2.1 which are processed by an agricultural product processing 2.2 facility. 2.3 Sec. 2. Minnesota Statutes 1994, section 41B.046, is 2.4 amended by adding a subdivision to read: 2.5 Subd. 4a. [CERTAIN LIVESTOCK PROCESSING FACILITIES 2.6 ELIGIBLE.] An applicant may be eligible for a loan under this 2.7 section if: 2.8 (1) the facility is owned and operated by a cooperative 2.9 organized under chapter 308A. For purposes of this subdivision, 2.10 "owned and operated" includes a contractual arrangement with 2.11 another entity to provide management and operations services for 2.12 a facility owned by the cooperative; and 2.13 (2) its agricultural product processing facility is located 2.14 in Minnesota and operated primarily for the processing of 2.15 livestock. 2.16 Sec. 3. [EFFECTIVE DATE.] 2.17 Sections 1 and 2 are effective the day following final 2.18 enactment.
