  1.1                          A bill for an act 
  1.2             relating to boiler inspection; authorizing inspections 
  1.3             by nationally certified agencies; amending Minnesota 
  1.4             Statutes 2002, sections 183.02, by adding a 
  1.5             subdivision; 183.375, subdivision 2; 183.57, 
  1.6             subdivisions 1, 2, 4; 183.61, subdivision 6. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 183.02, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 4.  [AUTHORIZED INSPECTION AGENCY.] "Authorized 
  1.11  inspection agency" means a company or firm recognized and 
  1.12  accredited by either the American Society of Mechanical 
  1.13  Engineers or the National Board of Boiler and Pressure Vessel 
  1.14  Inspectors to perform safety inspections of boilers and pressure 
  1.15  vessels. 
  1.16     Sec. 2.  Minnesota Statutes 2002, section 183.375, 
  1.17  subdivision 2, is amended to read: 
  1.18     Subd. 2.  [CHIEF OF DIVISION.] Subject to the provisions of 
  1.19  chapter 43A, the commissioner shall appoint a chief and may 
  1.20  appoint a deputy chief of the division of boiler inspection.  
  1.21  The appointee shall be a qualified steam engineer with at least 
  1.22  ten years of operation experience as such and shall be licensed 
  1.23  as a chief Grade A engineer in this state and shall possess a 
  1.24  current commission issued by the national board of boiler and 
  1.25  pressure vessel inspectors.  Inspectors employed in the division 
  1.26  of boiler inspection or employed as an authorized inspector by a 
  2.1   qualified insurance company insuring an authorized inspection 
  2.2   agency inspecting boilers and pressure vessels in Minnesota may 
  2.3   utilize up to five years of equivalent experience as inspectors, 
  2.4   in satisfying the requirement of ten years of experience as 
  2.5   steam engineers for the chief and deputy chief positions.  
  2.6      Sec. 3.  Minnesota Statutes 2002, section 183.57, 
  2.7   subdivision 1, is amended to read: 
  2.8      Subdivision 1.  [REPORT REQUIRED.] Any insurance company 
  2.9   insuring authorized inspection agency inspecting boilers and 
  2.10  pressure vessels in this state shall make a written report 
  2.11  thereof showing the date of inspection, the name of the person 
  2.12  making the inspection, the condition of the boiler or pressure 
  2.13  vessel as disclosed by the inspection, whether the same is 
  2.14  operated by a properly licensed engineer, and whether a policy 
  2.15  of insurance notice of inspection has been issued by the company 
  2.16  agency with reference to the boiler or pressure vessel.  Within 
  2.17  15 days after the inspection, the insurance company authorized 
  2.18  inspection agency shall mail a copy of the report to the chief 
  2.19  boiler inspector and a copy of the report to the person, firm, 
  2.20  or corporation owning or operating the boiler or pressure vessel 
  2.21  inspected.  Such report shall be made annually for boilers and 
  2.22  biennially for pressure vessels. 
  2.23     Sec. 4.  Minnesota Statutes 2002, section 183.57, 
  2.24  subdivision 2, is amended to read: 
  2.25     Subd. 2.  [EXEMPTION.] Every boiler or pressure vessel as 
  2.26  to which any insurance company authorized inspection agency 
  2.27  authorized to do business in this state has issued a policy of 
  2.28  insurance notice of inspection, after the inspection thereof, is 
  2.29  exempt from inspection made under sections 183.375 to 183.62, 
  2.30  while the same continues to be insured periodically inspected as 
  2.31  required by law and the person, firm, or corporation owning or 
  2.32  operating the same has an unexpired certificate of exemption 
  2.33  from inspection, issued by the chief boiler inspector.  The fee 
  2.34  set by the commissioner pursuant to section 16A.1285, on the 
  2.35  first object inspected and on each object thereafter shall apply 
  2.36  to each exempt object.  A certificate of exemption expires one 
  3.1   year from date of issue.  The certificate of exemption shall be 
  3.2   posted in a conspicuous place near the boiler or pressure vessel 
  3.3   or in the plant office or boiler room described therein and to 
  3.4   which it relates.  Every insurance company authorized inspection 
  3.5   agency shall give written notice to the chief boiler inspector 
  3.6   of the cancellation or expiration of every policy of insurance 
  3.7   notice of inspection issued by it with reference to policies 
  3.8   inspections in this state, and the cause or reason for the 
  3.9   cancellation or expiration.  These notices of cancellation or 
  3.10  expiration shall show the date of the policy most recent 
  3.11  inspection and the date when the cancellation has or will become 
  3.12  effective. 
  3.13     Sec. 5.  Minnesota Statutes 2002, section 183.57, 
  3.14  subdivision 4, is amended to read: 
  3.15     Subd. 4.  [CERTIFICATE OF EXEMPTION.] The division of 
  3.16  boiler inspection may issue a billing and exemption certificate 
  3.17  for each boiler and pressure vessel which the division records 
  3.18  indicate shall be or has been inspected by an insurance company 
  3.19  which is providing coverage for the boilers and pressure vessels 
  3.20  authorized inspection agency.  The division may determine the 
  3.21  monthly schedule of the billings to be followed for each 
  3.22  business insured inspected.  
  3.23     Sec. 6.  Minnesota Statutes 2002, section 183.61, 
  3.24  subdivision 6, is amended to read: 
  3.25     Subd. 6.  [INSURANCE INSPECTION REPORTS.] Any insurance 
  3.26  company authorized inspection agency that fails to comply with 
  3.27  the requirements of section 183.57 is guilty of a misdemeanor.  
  3.28     Sec. 7.  [EFFECTIVE DATE.] 
  3.29     Sections 1 to 6 are effective July 1, 2003.
