  1.1                          A bill for an act 
  1.2             relating to human services; providing an offset for 
  1.3             provider surcharges paid erroneously; appropriating 
  1.4             money. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PROVIDER SURCHARGE OFFSET.] 
  1.7      The commissioner of human services shall reduce future 
  1.8   billings under Minnesota Statutes, section 256.9657, to offset 
  1.9   $1,600,000 in excess provider surcharges erroneously collected 
  1.10  from a health care system.  The future billings must be reduced 
  1.11  by $400,000 in each of the fiscal years beginning with fiscal 
  1.12  year 2002 through fiscal year 2005, for a total reduction of 
  1.13  $1,600,000. 
  1.14     Sec. 2.  [APPROPRIATIONS.] 
  1.15     $800,000 is appropriated from the general fund to the 
  1.16  commissioner of human services for the biennium beginning July 
  1.17  1, 2001, for the purposes of section 1.  This appropriation 
  1.18  becomes part of base level funding for the commissioner for the 
  1.19  biennium beginning July 1, 2003, but is canceled effective June 
  1.20  30, 2005.
