A bill for an act
relating to building codes; requiring pan flashing under all exterior windows and
doors; proposing coding for new law in Minnesota Statutes, chapter 16B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin "Pan flashing" means a type of corrosion-resistive
flashing that is integrated into the building envelope at the base of a window or door rough
opening and that diverts incidental water to the exterior of the cladding or to the exterior
surface of a concealed weather resistive barrier.

new text begin An approved pan flashing must be provided under all
exterior windows and doors. Pan flashing must be: (1) sloped to drain water to the
exterior of the cladding or the exterior surface of a concealed weather-resistive barrier;
or (2) flat with sealed back dam and side dams to prevent re-entry of water into the wall
cavity or onto interior finishes.

new text begin The requirement in subdivision 2 does not apply to:

new text begin (1) windows or doors where the manufacturer's written installation instructions
require an alternate flashing method;

new text begin (2) windows or doors in detached accessory structures;

new text begin (3) skylights or bow or bay windows;
new text end

new text begin (4) doors required to meet accessibility requirements that would prevent the
installation of pan flashing; and

new text begin (5) repairs or replacement of existing windows and doors.

new text begin The commissioner of labor and industry shall include the
requirements of this section in the next revision of the State Building Code.
